U.S. top court to hear dispute over California pregnancy center law

WASHINGTON (Reuters) – The U.S. Supreme Court on Monday agreed to decide whether a California law requiring private facilities that counsel pregnant women against abortion to post signs telling clients how to get state-funded abortions and contraceptives violates free speech rights.

The justices will hear an appeal brought by Christian-based non-profit facilities sometimes called “crisis pregnancy centers” of a lower court ruling that upheld the Democratic-backed 2015 California law. The challengers argue that the law, by forcing them to post the information, violates the U.S. Constitution’s First Amendment guarantee of free speech.

California argued that the Reproductive FACT Act, passed by a Democratic-led legislature and signed by Democratic Governor Jerry Brown, is justified by its responsibility to regulate the healthcare industry and is needed to ensure that women know the state has programs providing abortions and birth control.

The law requires licensed healthcare facilities to post a notice saying that the state has programs for “immediate free or low-cost access to comprehensive family planning services … prenatal care, and abortion for eligible women.” For non-licensed medical facilities, an additional notice is required stating that the center “has no licensed medical provider who provides or directly supervises the provision of services.”

The facilities had asked the high court to hear their appeal of a ruling last year by the San Francisco-based 9th U.S. Circuit Court of Appeals upholding the law.

In 2014, the U.S. Supreme Court declined to take up a challenge to similar law in New York City, although that case differed from the California dispute because the lower court had struck down several provisions, including one that required centers to disclose whether they provide abortions and other reproductive care.

The “crisis pregnancy centers” counsel women not to have abortions. These facilities, according to critics, often are located near hospitals and abortion clinics, offer ultrasounds and are staffed by people wearing medical garb. Some are medically licensed facilities, others are not.

Challengers included the National Institute of Family and Life Advocates, an umbrella group for anti-abortion pregnancy crisis centers that said its members include 73 centers in California that are medically licensed and 38 that are not.

The other plaintiffs are two centers in San Diego County: Pregnancy Care Center and Fallbrook Pregnancy Resource Center. The court did not act on three other cases brought by other centers making similar claims.

The Supreme Court found that women have a constitutional right to an abortion in the landmark 1973 case Roe v. Wade. The court most recently backed abortion rights in 2016 when it struck down a Texas law that imposed strict regulations on clinics that provided abortions.

JAKARTA (Reuters) – Jakarta’s once hugely popular governor is being held in a simple room at a high-security detention center, his only comforts a Bible and visitors twice a week. It’s a grim new life following his conviction for insulting Islam in Muslim-majority Indonesia.

Basuki Tjahaja Purnama was hurriedly transferred to the high-security police facility in a suburb of the city early on Wednesday after his supporters surrounded the Jakarta jail he was initially sent to.

His sister said the family also feared his life was in danger from furious Islamists.

“The religious people have been saying in the mosques that his blood is haram (forbidden) and that killing him is good,” Fifi Lety Indra, the sister and head of his legal team, told Reuters. “This is necessary protection and it gives us peace and comfort that he’s there.”

His two-year imprisonment on Tuesday was much harsher than the suspended sentence the prosecution had sought for the ethnic-Chinese Christian governor, prompting warnings that Islam is creeping into politics and the judiciary of the secular nation.

The blasphemy conviction is a stunning downfall for the close ally of President Joko Widodo. Brash and unafraid to take on the moneyed elite, Purnama – popularly known by his Chinese nickname ‘Ahok’ – was widely admired for his no-nonsense drive to modernize a chaotic city long plagued by traffic and flooding.

His fortunes turned last September, when he was seeking re-election. He said his political rivals were deceiving people by using a verse from the Koran to say Muslims should not be led by a non-Muslim. Indonesia is the world’s largest Muslim-majority country.

Purnama denied the blasphemy allegation but apologized for the comments. But hardline groups drew hundreds of thousands of protesters onto the streets of Jakarta, calling for him to be sacked and jailed for insulting Islam’s holy book.

Popular sentiment turned against him after those demonstrations and he lost his bid for another term as governor in elections this year. His trial, which began late last year, took religious tensions in Indonesia to their highest in years.

BLOCKING TRAFFIC

Purnama was initially taken to Cipinang Penitentiary in East Jakarta, a Dutch colonial-era high-security prison notorious for its overcrowding and home to convicted drug offenders and Islamist militants.

He was moved to a police compound in Depok on the outskirts of Jakarta because his supporters were blocking traffic around the Cipinang prison. Some even attempted to topple a barbed-wire fence there.

His sister Indra brought their mother to meet him in Depok on her birthday.

“We met him in prison with our Muslim siblings, we hugged, we cried. The whole thing happened so fast,” Indra said.

Though Purnama was born to non-Muslim parents and is a Christian, he was adopted by a Muslim family on the tiny island of Belitung, off Sumatra.

He does not have a phone or a television in the police facility, and Indra said the only book he took with him was a Bible. “He loves reading his Bible. He has it with him and he can pray whenever he wants,” she said.

Purnama was allowed to bring his own clothes and toiletries, she said. “I can say he’s being treated very well and humanely. We are very grateful for that.”

SENTENCE

Indra said he is in a “temporary holding room” but is likely to be moved to a private cell soon. He will be allowed visitors twice a week for two hours each time, she said.

Purnama’s legal team is preparing an appeal to challenge his prison sentence.

His lawyers have also submitted a request to the Jakarta High Court to have his sentence commuted to a ban on him traveling outside Jakarta.

Purnama was due to stay in office until October, when the winner of April’s run-off election, Anies Baswedan, will take over.

Indra paid tribute to President Widodo, under whom Purnama had served as deputy governor of Jakarta before taking charge of the city when Widodo won the presidency in 2014.

“We understand how difficult the situation is for him but he’s a wise man,” she said. “He and my brother have a beautiful bond of friendship still.”

JAKARTA (Reuters) – Jakarta’s Christian governor was sentenced to two years in jail for blasphemy against Islam on Tuesday, a harsher than expected ruling that is being seen as a blow to religious tolerance in Indonesia, the world’s largest Muslim-majority nation.

The guilty verdict comes amid concern about the growing influence of Islamist groups, who organized mass demonstrations during a tumultuous election campaign that ended with Basuki Tjahaja Purnama losing his bid for another term as governor.

President Joko Widodo was an ally of Purnama, an ethnic-Chinese Christian who is popularly known as “Ahok”, and the verdict will be a setback for a government that has sought to quell radical groups and soothe investors’ concerns that the country’s secular values were at risk.

As thousands of supporters and opponents waited outside, the head judge of the Jakarta court, Dwiarso Budi Santiarto, said Purnama was “found to have legitimately and convincingly conducted a criminal act of blasphemy, and because of that we have imposed two years of imprisonment”.

Andreas Harsono of Human Rights Watch described the verdict as “a huge setback” for Indonesia’s record of tolerance and for minorities.

“If someone like Ahok, the governor of the capital, backed by the country’s largest political party, ally of the president, can be jailed on groundless accusations, what will others do?,” Harsono said.

WEEPING SUPPORTERS

Purnama told the court he would appeal the ruling. The governor was taken to an East Jakarta prison after the verdict and his lawyer Tommy Sihotang said he would remain there despite his appeal process unless a higher court suspended it.

Shocked and angry supporters, some weeping openly, gathered outside the prison, vowing not to leave the area until he was released, while others vented their shock on social media.

Some lay down outside the jail blocking traffic, chanting “destroy FPI”, referring to the Islamic Defenders Front, a hardline group behind many of the protests against Purnama.

“They sentenced him because they were pressured by the masses. That is unfair,” Purnama supporter Andreas Budi said earlier outside the court.

Home affairs minister Tjahjo Kumolo said Purnama’s deputy would take over in the interim.

Thousands of police were deployed in the capital in case clashes broke out, but there was no immediate sign of any violence after the court’s verdict.

Prosecutors had called for a suspended one-year jail sentence on charges of hate speech. The maximum sentence is four years in prison for hate speech and five years for blasphemy.

Hardline Islamist groups had called for the maximum penalty possible over comments by Purnama that they said were insulting to the Islamic holy book, the Koran.

While on a work trip last year, Purnama said political rivals were deceiving people by using a verse in the Koran to say Muslims should not be led by a non-Muslim.

An incorrectly subtitled video of his comments later went viral, helping spark huge demonstrations that ultimately resulted in him being bought to trial.

Purnama denied wrongdoing, though he apologized for the comments made to residents in an outlying Jakarta district.

RADICAL ISLAMIST GROUPS

Purnama lost his bid for re-election to a Muslim rival, Anies Baswedan, in an April run-off – after the most divisive and religiously charged election in recent years. He is due to hand over to Baswedan in October.

If Purnama’s appeals failed, he would be prevented from holding public office under Indonesian law because the offence carried a maximum penalty of five years, said Simon Butt of the Centre for Asian and Pacific Law at the University of Sydney.

Analysts say the radical Islamist groups that organized mass protests against Purnama had a decisive impact on the outcome of the gubernatorial election.

Rights group fear Islamist hardliners are in the ascendant in a country where most Muslims practise a moderate form of Islam and which is home to sizeable communities of Hindus, Christians, Buddhists, and people who adhere to traditional beliefs.

The government has been criticized for not doing enough to protect religious minorities but Widodo had urged restraint over the trial and called for all sides to respect the legal process.

His government said on Monday it would take legal steps to disband Hizb ut-Tahrir Indonesia (HTI), a group that seeks to establish an Islamic caliphate, because its activities were creating social tensions and threatening security.

WASHINGTON (Reuters) – The U.S. Congress taking office on Tuesday remains almost as overwhelmingly Christian as it was in the 1960s even while the share of American adults who call themselves Christians has dropped, according to Pew Research Center analysis.

A report from the nonpartisan group said that 91 percent of lawmakers in the Republican-dominated 115th Congress described themselves as Christians, down slightly from 95 percent in the 87th Congress in 1961 and 1962, the earliest years for comparable data.

By contrast, the portion of American adults who call themselves Christian fell to 71 percent in 2014, the Pew report said. While Pew did not have numbers for the early 1960s, a Gallup survey from that time found that 93 percent of Americans described themselves as Christian.

“The most interesting thing is how little Congress has changed over the past several decades, especially in comparison with the general public,” Aleksandra Sandstrom, the report’s lead author, said in a telephone interview.

The biggest gap between Congress and other Americans was among those who said they have no religion. Only one lawmaker, Democratic Representative Kyrsten Sinema of Arizona, called herself religiously unaffiliated. The Pew survey found that 23 percent of Americans described themselves the same way.

The percentage of Americans who have no religion has grown, but the portion of voters who said in exit polls that they have no religion is lower than the share of the general public, said Greg Smith, a Pew expert on the U.S. religious landscape.

“The political power of that group might lag their growth in the overall population,” he said.

Among the 293 Republicans elected to the new Congress, all but two identify as Christians. The two Jewish Republicans – Lee Zeldin of New York and David Kustoff of Tennessee – serve in the House.

The 242 Democrats in Congress are 80 percent Christian, but that side of the aisle includes 28 Jews, three Buddhists, three Hindus, two Muslims and one Unitarian Universalist.

The share of Protestants in Congress has dropped to 56 percent today from 75 percent in 1961, while the portion of Catholics in Congress has risen to 31 percent from 19 percent.

The U.S. population in 2014 was 46.5 percent Protestant and 21 percent Catholic, the Pew survey showed.

The survey was based on data gathered by CQ Roll Call through questionnaires and phone calls to members of congress and candidates’ offices.

In Jerusalem’s cramped Old City, Christians feel the squeeze

JERUSALEM, June 21 (Reuters) – – When hundreds of Jewish nationalists marched through the Muslim Quarter of Jerusalem’s Old City this month, waving banners and chanting songs in what has become an annual ritual, it wasn’t only Muslims watching warily. Christians were, too.

Religious tension is nothing new in a city that has been the home of three faiths for centuries. But the outlook for the Christian minority, squeezed inside the ancient walls of the Old City and caught in the midst of a months-long wave of violence involving Muslims targeting Jews, has seldom looked tougher.

While the Muslim population rises steadily, now making up 75 percent of the 38,000 residents in the city’s alleys, and the Jews increasingly make their presence felt via the annual march and their settlements beyond the Jewish Quarter, the number of Christians has not risen in 50 years, hovering around 7,000.

“If a thousand Muslims leave Jerusalem, that’s one thing,” said Jamal Khader, head of the Latin Patriarchate Seminary near Bethlehem. “But if a thousand Christians leave, you threaten the identity of Jerusalem as a city of multiple faiths.”

That concern is clear to Basil Saed, 28, the owner of a gym in the Christian Quarter. After an attempted stabbing by a Muslim in the Old City several weeks ago, Saed came face-to-face with an Israeli military policeman hunting for the suspect.

“He was trembling he was so terrified,” said Saed, a prize-winning weightlifter who wears a large gold cross around his neck. “In an instant he could have shot and killed me.”

To Saed, both Israel’s tight security and the Muslim unrest make him uneasy, and raise questions for his community.

“If we weren’t strong, we’d all be gone by now,” he said.

SQUEEZED OUT

In the narrow, cobbled streets of their quarter, Christian families have been running arts and souvenir shops for generations, earning money from the steady flow of religious and other tourists who flock to sites like the Church of the Holy Sepulchre, the site where Jesus is believed to have been buried.

With the surge in violence that Jerusalem and surrounding areas have experienced since last October, tourism has become more erratic. Anecdotally, locals and tour guides say visitor numbers have dropped off sharply, hurting trade.

Residents like Youseph Shbeita, 35, the third generation owner of a religious icon shop near the Holy Sepulchre, are determined to hang on, seeing no option. But they can understand why younger Christians would want to leave.

“When you’re in the minority, you have to go with the flow,” he said, expressing a sense of responsibility for trying to preserve a Christian presence in the city where Jesus preached. “We just hope for calm, always for calm.”

Daniel Seidemann, an Israeli lawyer and activist who closely follows the community, said he feared it was being squeezed out by the Israeli-Palestinian conflict, with its tendency to focus on the Jewish and Muslim narratives.

“Since much of the epicenter of this round of violence has been in and around the Old City, it has increased their vulnerability,” he said, pointing to the lack of political and social institutions for Christians to depend on.

“I think it’s safe to say there are more Christian Palestinians in Chicago today than there are in Jerusalem.”

Most of the Christians in Jerusalem are Palestinians. Historically, the community has played a prominent role in the opposition to Israel’s occupation of East Jerusalem and the West Bank, putting it at odds with Israel.

Inside the walls of the Old City, however, there is still a degree of mutual dependence – Muslim merchants run stores on land owned by the Christian church, and Israeli Jews stop to buy fruit or a felafel from Muslim and Christian stallkeepers.

Even so, Saed, the weightlifter, doesn’t feel confident.

“For now, the Muslims and Jews are fighting each other,” he said. “But when they stop they’ll both look at us.”

Good Morning North Korea! Defector takes to the airways

SEOUL (Reuters) – For an hour each day, Kim Chung-seong, a defector from North Korea and a Christian missionary, takes to the microphone in a small Seoul studio.

At 1 a.m., his show, “Hello from Seoul, the Republic of Korea,” sends a mix of gospel music and news into North Korea, defying the isolated state’s efforts to keep its people in the dark about the world, religion and the truth about its leaders.

“Brothers and sisters in the North, I hope this time can be a moment of prayer for a miracle that every party member of North Korea at the party congress can meet God, not take a further step into the cult of personality,” Kim said.

He was referring to the meeting of the North’s ruling Workers’ Party this month, where young leader Kim Jong Un was unanimously elevated to party chairman.

“I am desperately praying that North Korea’s Kim Jong Un and all administrators under him kneel down in front of God and repent for their sins, leave the path of tormenting their people,” Kim, who came to the South in 2004, said in his studio at the Far East Broadcasting Company.

North Korea strictly bans access to outside information, but a growing number of North Koreans consume illicit media, including South Korean TV dramas that show the prosperity of life across the heavily fortified border, via contraband USB sticks and DVDs smuggled from China.

The impoverished North is still technically at war with rich, democratic South Korea because their 1950-53 conflict ended in a truce, not a treaty. It has also been slapped with UN and other sanctions for its nuclear and missile programmes.

Robert King, U.S. special envoy for North Korean human rights issues, told a Senate panel in October that up to 29 percent of North Koreans had listened to foreign radio and said the medium, including the U.S. government’s Voice of America, remained the most important way to get information into the country.

“LISTENING UNDER THE BLANKET”

Kim Myung-jun, professor at Sogang University’s school of mass communications in Seoul, said smuggled USB sticks and DVDs were more about entertainment, whereas radio carried news.

“Once you listen in, you tend to keep listening under the blanket. It gets you addicted,” he said. “AM radio stations like Far East Broadcasting Company have pretty good signals and can be listened to clearly in much of North Korea.”

Kim, the broadcaster, said he tried to delegitimise the three-generation Kim family dictatorship and preach Christian gospel on his show, often with fellow defectors as guests.

“I am not saying everything is bad in North Korea,” said Kim, 39, who has hosted the show for six years.

“But, for example, if the party congress is meant to worship one particular person and make 20 million people that person’s slaves, that is meaningless. That’s what I am talking about on my show.”

North Korea’s constitution guarantees freedom of religion provided it does not undermine the state, but outside of a small handful of state-controlled places of worship, no open religious activity is allowed.

It is also illegal to own a radio that can be tuned, and the only radio or TV sets permitted are those pre-set to state channels. However, many tune in to foreign shows with smuggled Chinese radios and illegally altered North Korean sets.

One weekly guest, defector Ko Ji-eun, said she was a fan of Kim’s show while hiding in China for several years.

After she arrived in Seoul last year, Ko met a fellow defector who had listened to the show while inside the North last year and has since fled to the South.

“North Koreans are now using Chinese earphones not to expose themselves to authorities,” Ko said. “Many people inside North Korea are listening to this radio a lot.”

Day of Violence in Nigeria Leaves 60 Dead

Islamic terrorists launched a day of violence in Nigeria against both Christians and Muslims on Sunday leaving more than 60 dead.

Boko Haram bombed a crowded mosque and Muslim restaurant in the city of Jos.  Muslim community lawyer Ahmed Garba told Fox News that 51 people died in the twin attacks and were buried on Monday.  An additional 67 were wounded and remain hospitalized.

A witness said that the bomber at the mosque appeared to be targeting cleric Sani Yahaya.

“He is a great Islamic scholar who has spoken out against Boko Haram, and that is why we believe he was the target,” Danladi Sani told The Associated Press.

The terrorists also attacked an evangelical Christian church in Potiskum along with a campaign of arson against villages that burned over 300 homes.

Boko Haram has ramped up violence in response to a call by ISIS terrorists for increased activity during the Muslim holy month of Ramadan.

President Muhammadu Buhari condemned the attacks and said that he will protect the rights of Nigerians to freely worship.

In the last week the terrorist group has killed over 300 people.
