Venezuela arrests six over drone explosions during Maduro speech

CARACAS (Reuters) – Venezuelan authorities said on Sunday they have detained six people over drone explosions the day before at a rally led by President Nicolas Maduro, as his critics warned the socialist leader would use the incident to crack down on adversaries.

The suspects launched two drones laden with explosives over an outdoor rally Maduro was holding in downtown Caracas to commemorate the National Guard, Interior Minister Nestor Reverol said. One was “diverted” by security forces while the second fell on its own and hit an apartment building, Reverol

said.

The attack highlights Maduro’s challenges in maintaining control over the OPEC nation, where widespread food and medicine shortages have fueled outrage and despair everywhere from hillside slums to military barracks.

“These terrorist acts represent a slap in the face to the expressed desire of the President of the Republic, Nicolas Maduro, for national reconciliation and dialogue,” Reverol said in a statement read on state television.

State television footage of the rally showed Maduro startled by what appeared to be an explosion and footage later panned to soldiers lined up on a boulevard who chaotically broke ranks in what appeared to be a reaction to a second blast.

The president later described the attack, which injured seven soldiers, as an assassination attempt.

One of the suspects had an outstanding arrest warrant for involvement in a 2017 attack on a military base that killed two people, Reverol said, an incident that followed four months of anti-government protests.

A second suspect had been detained during a wave of anti-Maduro protests in 2014 but had been released through “procedural benefits,” Reverol said, without offering details.

He did not name the suspects.

The arrests suggest the attack was less a military uprising than an assault led by groups linked to anti-Maduro street protesters, dubbed “The Resistance,” who have led two waves of violent demonstrations that left hundreds dead.

That is consistent with the shadowy group that claimed responsibility for the attack, The National Movement of Soldiers in T-Shirts, whose website says it was created in 2014 to bring together different groups of protesters.

Reuters was unable to independently confirm the involvement of the group, which did not respond to requests for comment on the arrest announcements or identify any of its members.

‘I SAW THE LITTLE PLANE’

Bolivar Avenue of downtown Caracas, where the incident took place, was calm on Sunday.

Joggers and cyclists were taking up two of the lanes that are traditionally used for weekend recreation. The stage where Maduro spoke had been removed.

Witnesses said they heard and felt an explosion in the late afternoon, then saw a drone fall out of the sky and hit a nearby building.

“I heard the first explosion, it was so strong that the buildings moved,” said Mairum Gonzalez, 45, a pre-school teacher. “I went to the balcony and I saw the little plane … it hit the building and smoke started to come out.”

Two witnesses said they later saw security forces halt a black Chevrolet and arrest three men inside it.

The security forces later took apart the car and found what appeared to be remote controls, tablets, and computers, said the two, who identified themselves as Andres and Karina, without giving their last names.

Opposition critics accuse Maduro of fabricating or exaggerating security incidents to distract from hyperinflation and Soviet-style product shortages.

Leopoldo Lopez, formerly mayor of Caracas’ district of Chacao, for example, is under house arrest for his role in 2014 street protests that Maduro described as a coup attempt but his adversaries insisted were a form of free expression.

“We warn that the government is taking advantage of this incident … to criminalize those who legitimately and democratically oppose it and deepen the repression and systematic human rights violations,” wrote the Broad Front opposition coalition in a statement published on Twitter.

Maduro’s allies counter that the opposition has a history of involvement in military conspiracies, most notably in the 2002 coup that briefly toppled socialist leader Hugo Chavez.

“I have no doubt that everything points to the right, the Venezuelan ultra-right,” Maduro said on Saturday night. “Maximum punishment! And there will be no forgiveness.”

Maduro, who blames the country’s problems on an “economic war” led by adversaries, during the course of his five-year rule has often announced having foiled military plots against him that he says are backed by Washington.

U.S. national security adviser John Bolton told Fox News in an interview on Sunday that the United States was not involved in the blast.

Syrian, Iraqi forces say U.S. bombs military border positions, U.S. denies

BEIRUT (Reuters) – Syrian state media said on Monday that U.S.-led coalition aircraft had bombed a Syrian army position near the Iraqi border, causing deaths and injuries, but the U.S. military denied it was responsible.

The attack took place in al-Harra, southeast of the town of Albu Kamal, state news agency SANA said, citing a military source. SANA said the attack caused an unspecified number of deaths and injuries.

A commander in the alliance fighting alongside Damascus told Reuters that drones that were “probably American” had bombed the positions of Iraqi factions between Albu Kamal and Tanf, as well as Syrian military positions.

The commander, who is not Syrian and spoke on condition of anonymity, said the strike had killed and injured some Iraqi fighters but he did not give any numbers.

Iraq’s Popular Mobilisation Forces, a grouping of mostly Iran-backed Shi’ite paramilitaries, said a U.S. air strike on the Iraqi border with Syria killed 22 of its members and wounded 12 others.

“At 22:00 last night a U.S. plane hit a fixed headquarters of the Popular Mobilisation Forces’ 45th and 46th brigades defending the border strip with Syria using two guided missiles which led to the martyrdom of 22 fighters,” it said in a statement.

It demanded an explanation from the United States.

“No member of the U.S.-led coalition carried out strikes near Albu Kamal,” Major Josh Jacques, a U.S. Central Command spokesman, told Reuters.

The U.S.-led coalition uses air power and special forces to back an alliance of Syrian Arab and Kurdish militia fighting Islamic State northeast of Albu Kamal. U.S. forces also are based around the Tanf crossing, southwest of the town in the Syrian desert near the borders of Iraq and Jordan.

President Bashar al-Assad’s army, with the help of Iran-backed militias including Hezbollah and Iraqi groups, drove Islamic State from Albu Kamal and its environs last year but the jihadists have since staged attacks there.

The Popular Mobilisation Forces have been officially included in Iraq’s governmental forces but many of them still maintain loyalties to their former leaders and political groups. They said the base that was hit was 700 meters into Syrian territory and the Syrian government was aware of their presence.

A U.S. official, speaking on the condition of anonymity, said the U.S. military was concerned that Popular Mobilisation Forces could retaliate against American forces in Iraq. The official said the Pentagon was going out of its way to publicly make clear that it was not involved in the strike in order to minimize the risk of retaliation.

The United States acknowledges that it has about 5,200 troops in Iraq that are part of a coalition fighting Islamic State militants.

“OCCUPYING FORCES”

The Syrian Observatory for Human Rights, a war monitor, said unidentified planes had struck Lebanon’s Shi’ite Hezbollah and other allied foreign militias around Albu Kamal.

The UK-based Observatory said the strikes had killed 52 people. Reuters could not independently verify the Observatory’s report of casualties.

Asked about the reported air strikes, an Israeli military spokeswoman said: “We do not comment on foreign reports.”

Throughout Syria’s seven-year war, Israel has carried out scores of strikes within the neighboring country against what it describes as Hezbollah or Iranian targets.

Israel, alarmed about the clout of arch enemies Iran and Hezbollah, has pressed Russia, Assad’s other key ally, to make sure Tehran does not entrench its military sway in Syria.

Prime Minister Benjamin Netanyahu told his cabinet he had “repeated and clarified” his Syria policy in weekend phone calls with Russian President Vladimir Putin and U.S. Secretary of State Mike Pompeo.

“First of all, Iran must clear out of all of Syria,” Netanyahu said on Sunday, according to a statement from his office. “Secondly, we will take action, and are already taking action, against the attempted military entrenchment of Iran and its proxies, both close to the border and deep within Syria.”

In an interview last week, Assad called Hezbollah “a basic element” in the war and said “the need for these military forces will continue for a long time”.

He said the United States was an occupying power in Syria and that his state supported “any act of resistance, whether against terrorists or against occupying forces, regardless of their nationality.”

Gazans send fire-starting kites into Israel; minister threatens lethal response

ISRAEL-GAZA BORDER (Reuters) – Palestinians are sending kites dangling coal embers or burning rags across the Gaza border to set fire to farmland and forests, in a new tactic that an Israeli minister said should be countered with “targeted assassinations”.

At least 120 Palestinians have been killed by Israeli troops during mass demonstrations along the Gaza border since March 30 and the men sending the kites over the fence believe they have found an effective new weapon.

“It began spontaneously. We never thought we would achieve such good results,” said Shadi, one of five Palestinian teenagers preparing kites with fabric dipped in diesel and lubricant oil in a Gaza field.

“The idea is simple: use the simplest tools to cause damage and losses on the Occupation (Israel),” said Shadi, 19, wearing a “V for Vendetta” mask favored by protesters in many parts of the world and who, like the others, declined to give his last name.

No one has been hurt by the fires, but some 2,250 acres (910 hectares) of fields and nature reserves, already parched after a dry winter, have been burned by flames stoked by Mediterranean winds, causing $2.5 million in damage, Israel’s government said.

Public Security Minister Gilad Erdan said Israeli snipers should shoot the kite flyers.

“I expect the IDF (Israeli army) to handle these kite-flyers exactly as they would any terrorist, and the IDF’s targeted assassinations must also apply to these kite-flyers.”

Israel has drafted in civilian drone enthusiasts as army reservists, instructing them to fly their remote-controlled aircraft into the kites, an Israeli general said.

“If their drone ends up getting lost in the process, we compensate them,” he told Reuters, speaking on condition of anonymity.

The army has also fitted larger surveillance drones with weighted fishing lines or blades that can snag or slash kite strings in mid-air, the general said.

But he acknowledged the limitations of such measures, saying: “We’ll probably end up having to shoot kite-flyers too.”

Daniel Ben-David, a forestry official for Israel’s quasi-governmental Jewish National Fund, said some kites had been decorated with swastikas or the Palestinian national colors, but more recently were made of transparent nylon sheeting.

Some had leaflets attached. “Prepare for a scorching summer,” read one, in Hebrew.

In Gaza, kite-maker Shadi said his group had never used swastikas on their kites. He confirmed that transparent plastic was the best material as it made the kites almost invisible against the sky.

Even if the protests wind down, he and others will continue to send the kites – some of which carry the photos of Palestinians killed in the demonstrations – he said.

“Each kite costs us 10 shekels ($2.80). We pay it for it out of our own pockets,” Shadi said.

A senior White House envoy, Jason Greenblatt, described the kites as “not harmless playthings or metaphors for freedom (but) propaganda and indiscriminate weapons”.

Military can destroy drones over domestic U.S. bases: Pentagon

WASHINGTON (Reuters) – The Pentagon has given more than 130 U.S. military bases across the United States the green light to shoot down private and commercial drones that could endanger aviation safety or pose other threats.

The number of uncrewed aircraft in U.S. skies has zoomed in recent years and continues to increase rapidly – along with concern among U.S. and private-sector officials that dangerous or even hostile drones could get too close to places like military bases, airports and sports stadiums.

While the specific actions that the U.S. military can take against drones are classified, they include destroying or seizing private and commercial drones that pose a threat, Pentagon spokesman Navy Captain Jeff Davis told reporters on Monday.

The classified guidelines were distributed early last month. The Pentagon sent out unclassified guidance on how to communicate the policy to communities on Friday.

“The increase of commercial and private drones in the United States has raised our concerns with regards to the safety and security of our installations, aviation safety and the safety of people,” Davis said.

In April, flights of nearly all drones over 133 U.S. military facilities were banned due to security concerns.

Drones have become popular as toys and with hobbyists, and have commercial uses such as aerial photography. Amazon.com Inc <AMZN.O> and Alphabet Inc’s Google unit <GOOGL.O> have been exploring the use of drones to deliver goods ordered online.

The FAA estimated the commercial drone fleet would grow from 42,000 at the end of 2016 to about 442,000 aircraft by 2021. The FAA said there could be as many as 1.6 million commercial drones in use by 2021.

Singapore offers cargo plane, drones to help Philippines fight militancy

SINGAPORE (Reuters) – Singapore has offered a military transport airplane, drone surveillance aircraft and use of combat training facilities to support the Philippines’ fight against the rising threat of Islamist militancy, the defence ministry said on Wednesday.

The offer stemmed from talks in Manila earlier this week between Singapore Defence Minister Ng Eng Hen and his Philippines counterpart Delfin Lorenzana.

Surrounded by Muslim majority countries and with a Muslim minority of its own, Singapore is worried by the small but dangerous number of people in the region who have been radicalised by Islamic State.

Ministers describe the terror threat against the wealthy city-state as the highest in recent years and alarm was heightened in May when a militant group linked to Islamic State seized Marawi City on the southern Philippines island of Mindanao.

Security forces are still battling to regain control of the town and Philippine President Rodrigo Duterte this week asked Congress to extend martial law until the end of the year on Mindanao, the only Muslim majority island in the largely Catholic Philippines.

During the past two months Indonesia, Malaysia and the Philippines launched joint maritime and air patrols over their shared boundaries in the Sulu Sea, to guard against the movement of militants between Borneo Island and Mindanao.

Supporting the regional effort, Singapore’s Defence Ministry said that it had offered a C-130 transport plane to deliver humanitarian supplies, drone surveillance aircraft, and use of training facilities for the Philippines military.

“While the AFP (Armed Forces of the Philippines) is confident that Marawi will be secured from terrorists soon, further concerted efforts are required to ensure that other terrorist cells do not entrench themselves in the southern Philippines, as this would cause instability to the rest of ASEAN,” the ministry said in a statement.

Fearful that Islamic State could build a base in Southeast Asia, governments in the region announced last month that they plan share intelligence, using spy planes and drones to stem the movement of militants across their porous borders.

Southeast Asian nations step up cooperation as Islamic State threat mounts

SINGAPORE (Reuters) – Southeast Asian nations plan to use spy planes and drones to stem the movement of militants across their porous borders, defense officials said at the weekend, as concerns rise over the growing clout of Islamic State in the region.

Indonesia, Malaysia and the Philippines said they will launch joint air patrols this month at their shared boundaries in the Sulu Sea, in addition to existing maritime patrols.

Authorities in the region have urged greater cooperation to counter the fallout from a raging battle with Islamic State-linked militants in the southern Philippines, the biggest warning yet that the ultra-radical group is building a base in Southeast Asia.

“Our open borders are being exploited by terrorist groups to facilitate personnel and material,” Le Luong Minh, Secretary-General of the Association of Southeast Asian Nations (ASEAN) told the Shangri-La Dialogue, an annual regional security forum in Singapore.

The region is home to 600 million people and includes Indonesia, which has the world’s highest number of Muslims. Authorities in both Indonesia and Malaysia, also Muslim-majority, have said thousands of their citizens are sympathizers of Islamic State and hundreds are believed to have traveled to Syria to join the extremist group.

Indonesian authorities blamed Islamic State for bombings last month that killed three police officers, the latest in a series of low-level attacks by the militants in the last 17 months.

In recent months, dozens of fighters from Indonesia and Malaysia have crossed from their countries to Mindanao in the southern Philippines, intelligence officials have said, easily passing through waters that have often been lawless and plagued by pirates. Mindanao is the one region in the largely Catholic Philippines to have a significant Muslim minority.

ASEAN made a joint pledge with the United States on the sidelines of the Shangri-La forum to help the Philippines overcome the militant assault in the city of Marawi.

“What featured quite strongly in the U.S.-ASEAN meeting was the pledge by both U.S. and ASEAN members that we stand ready to help the Philippines…whether it’s information, intelligence or otherwise,” said Singaporean Defence Minister Ng Eng Hen.

JOINT PATROLS, INTELLIGENT-SHARING

Indonesia, Malaysia and the Philippines, with the assistance of neighboring Singapore, have carried out joint maritime patrols in the Sulu Sea since last year after a series of kidnappings by the pro-Islamic State Abu Sayyaf group.

“We decided at least these three countries, to avoid being accused of doing nothing…We’re doing joint maritime and air patrols,” said Malaysian Defence Minister Hishammuddin Hussein, adding that the air patrols will be launched on June 19.

“If we do nothing, they get a foothold in this region.”

Indonesian Defence Minister Ryamizard Ryacudu told Reuters his country will consider deploying drones and surveillance planes at its borders with the Philippines.

The measures come amid concerns that fighters may try to escape the military offensive in the Philippines, and flee to neighboring countries.

“We believe the elements involved in the Marawi clashes may try to escape through the southern Philippines and head either for Malaysian or Indonesian waters,” said Malaysia’s counter-terrorism police chief, Ayob Khan Mydin Pitchay.

“This is one of their only ways out.”

Among other measures, Singaporean and Malaysian officials said monitoring and intelligence-sharing on specific individuals had been stepped up in the wake of the fighting in Marawi.

Singapore’s Home Affairs Minister K. Shanmugam on Sunday urged residents of the wealthy city-state to report friends or family suspected of being radicalised, according to local media.

Security experts have warned that Southeast Asian countries are vulnerable to the spread of Islamic State as it suffers setbacks in Syria and Iraq.

“We’re seeing that, as Islamic State is losing ground on the battlegrounds of the Middle East, they’re pushing their franchise overseas as energetically as they can,” said Nigel Inkster of London’s International Institute for Strategic Studies.

“We’re seeing this in the southern Philippines but there are other countries in Southeast Asia, particularly Indonesia, that are at risk.”

Dos, don’ts and geo-fencing: Europe proposes rules for small drones

BERLIN (Reuters) – Europe’s aviation safety authorities have proposed rules for operating small drones that include requirements for geo-fencing technology to prevent them from straying into banned areas and a “dos and don’ts” leaflet to be inserted in retail packaging.

With demand booming, both for hobby and commercial use, European regulators have been looking for ways to ensure drones can be safely operated, while allowing the industry to grow.

Fears have been raised over the use of drones near airports in particular, with a number of pilots reporting near collisions with drones, and the European Aviation Safety Agency (EASA) has set up a task force to look into the risk of drone strikes.

EASA’s proposals include requirements for drones to be remotely identifiable, to be fitted with geo-fencing technology to prevent them from entering prohibited zones such as airports and nuclear sites, and a requirement for people operating drones weighing more than 250 grams to register themselves.

EASA hopes such measures will address privacy concerns, as well as safety risks.

The design requirements for small drones will be implemented using the CE product legislation commonly used across Europe.

Along with the CE marking, drones will be identified according to their class, and a “dos and don’ts” leaflet will be in all product boxes.

“Based on the drone class, an operator will know in which area he can operate and what competence is required,” EASA said in a statement.

The proposal is now open for comment from May 12 until Aug. 12 and EASA will submit its final opinion to the European Commission at the end of 2017.

The regulation of drones weighing less than 150 kg is currently up to individual EU member states, resulting in a fragmented regulatory framework.

Makers of commercial drones include China’s DJI and France’s Parrot <PARRO.PA>.

Connecticut may become first U.S. state to allow deadly police drones

NEW YORK (Reuters) – Connecticut would become the first U.S. state to allow law enforcement agencies to use drones equipped with deadly weapons if a bill opposed by civil libertarians becomes law.

The legislation, approved overwhelmingly by the state legislature’s judiciary committee on Wednesday, would ban so-called weaponized drones in the state but exempts agencies involved in law enforcement. It now goes to the House of Representatives for consideration.

The legislation was introduced as a complete ban on weaponized drones but just before the committee vote it was amended to exclude police from the restriction.

Connecticut Governor Dannel Malloy, a Democrat, was reviewing the proposal, “however in previous years he has not supported this concept,” spokesman Chris Collibee wrote in an email.

Civil libertarians and civil rights activists are lobbying to restore the bill to its original language before the full House vote.

“Data shows police force is disproportionately used on minority communities, and we believe that armed drones would be used in urban centers and on minority communities,” said David McGuire, executive director of the American Civil Liberties Union in Connecticut.

“That’s not the kind of precedent we want to set here,” McGuire said of the prospect that Connecticut would become the first state to allow police to use lethally armed drones.

In 2015, North Dakota became the first state to permit law enforcement agencies to use armed drones but limited them to “less than lethal” weapons such as tear gas and pepper spray.

So far, 36 states have enacted laws restricting drones and an additional four states have adopted drone limits, according to the National Conference of State Legislatures.

If Connecticut’s Democratic-controlled House passes the bill it will move to the Senate, which is split evenly between Democrats and Republicans.

Representative William Tong, a Democrat from Stamford, nor Senator John Kissel, a Republican from Enfield, who are co-chairs of the Judiciary Committee, were not immediately available for comment.

Whose sky is it anyway? U.S. drone case tests rights to air space

LONDON/WASHINGTON (Thomson Reuters Foundation) – When a small town American roofer took legal action against a neighbor for shooting down his drone, the local dispute sparked a case that could help shape the newest frontier of property rights law – who owns the air.

Drone owner David Boggs filed a claim for declaratory judgment and damages in the Federal Court after his neighbor William Merideth from Hillview in the southern state of Kentucky blasted his $1,800 drone with a shotgun in July last year.

Boggs argued to the District Court in Kentucky that the action was not justified as the drone was not trespassing nor invading anyone’s privacy, while Merideth – who dubs himself the “drone slayer” – said it was over his garden and his daughter.

After a year of counter argument, a decision on which court jurisdiction should hear the complaint is expected within weeks and this could set new precedents for U.S. law.

Experts are watching the case closely as the burgeoning drone industry, fueled both by hobbyists and commercial operators, highlights the lack of regulation governing lower altitude air space not just in the United States but globally.

“We are in an interesting time now when technology has surpassed the law,” said Boggs’ lawyer, James Mackler, a former Blackhawk pilot and partner at Frost Brown Todd and one of a handful of attorneys specializing in unmanned aircraft law.

“Operators need to know where they can fly and owners must know when they can reasonably expect privacy and be free of prying eyes,” said Mackler whose work involves advising both corporate and government clients planning commercial drone use.

The landmark case comes amid a sharp increase in the global market for drones, or unmanned aerial vehicles, with research firm, Markets and Markets estimating an annual growth rate of 32 percent every year to a $5.6 billion industry by 2020.

RIGHTS ABOVE?

The U.S. Federal Aviation Authority (FAA) forecasts about 2.5 million drones will be buzzing in U.S. skies by the end of 2016 – and that number will more than triple by 2020.

But with the global industry surging, all parties, including  Merideth, and Boggs’ lawyer, Mackler, agree the use of drones in lower air space urgently needs to be clarified and defined.

“To be honest with you, at the time I did what I did I was reacting as most homeowners would, protecting their property, their kids … I didn’t know who was operating the drone or for what purpose,” Merideth told the Thomson Reuters Foundation.

“In the end, I’m hoping that laws can be put into place to protect not just the home owner but the individual who owns the drone. They have rights too. It is a huge gray area and for now nobody knows what they are allowed to do.”

Mackler estimates about a drone a month is shot down in the United States as residents grapple with the legal confusion about what constitutes their property and their rights.

“What happens typically is that law enforcement doesn’t know what to do and civil suits are uncommon as most people don’t want to get involved due to the costs,” he told the Thomson Reuters Foundation in a telephone interview.

Boggs’ complaint states that the drone was flying at about 200 feet (6o m) above ground level for around two minutes over  residential Bullitt County when it was blasted out of the sky.

The height at which the drone was flying is disputed as Merideth insists it was much lower – an integral part of the legal case because higher airspace used by commercial planes is clearly defined in law.

For now, there is no real agreement on who owns the air space below that height and there are also no rules that identify who has the right to say how it can be used.

The court challenge filed by Boggs in January shows Merideth’s defense for downing the drone hinged on his belief it may have been taking video or still images of his daughter.

When Boggs challenged his neighbor, Merideth warned him that not only was he was protecting his family’s rights but he was not to come any further.

Police were called and Merideth was charged with felony, wanton endangerment and criminal mischief but Kentucky District Court Judge Rebecca Ward last October dismissed the criminal charges, saying he “had a right to shoot at the aircraft”.

Boggs’ lawyer Mackler said the case is not about payment for  the damaged drone but about carving legally clear boundaries between unregulated lower air space and personal property.

If the case is heard in the District Court, he said, it will not be binding in other federal court jurisdictions but will be influential in other courts. However, if it is appealed and sent to a higher court, it could create a precedent for the country.

OPENING THE SKIES

Despite the lack of legal clarity over air space, the United States moved to free up the use of small drones on Aug. 30  by relaxing rules requiring drone operators to have a manned pilots license and specific FAA approval.

These have been replaced with a new class of FAA license which is much less onerous and less expensive, allowing the use of drones weighing less than 25 kgs for routine educational or commercial use such as power line and antenna inspections.

The rules stopped short of allowing package deliveries, as proposed by Amazon.com Inc, and currently drones can only be used in sight of the operator and not over people.

The FAA expects within a year 600,000 drones will be used commercially – up from 20,000 registered now for commercial use.

Anglo-American property law scholars trace the first principles of law for the air back more than 800 years to the Latin “cujus est solum ejus est usque ad coelom et ad infernos”.

This effectively meant that earthly property ownership was deemed to include everything below land to the center of the earth and upwards in the sky to heaven.

But with the advent of commercial air travel this principle was laid to rest because property owners could not be considered as owners of the air thousands of feet above their homes if air travel was to prosper.

In the United States, the legal principles that emerged over the 20th century focused on nuisance: flights at great heights came to be permitted without regard to the rights of property owners, while low altitude flights, including take-offs and landings, had to factor in the impact on nearby property.

The most important case to define these principles in the United States involved the health of a farmer’s chickens.

Known as the ‘United States versus Causby,’ the challenge unfolded during World War II when noisy military aircraft started flying from the Greensboro-High Point Airfield and over Thomas Causby prosperous chicken farm near in North Carolina.

The constant roar of planes sent Causby’s 400 chickens into a frenzy and they stopped laying eggs, ruining his livelihood.

The farmer sued the Federal Government and both the lower courts and the Supreme Court found in his favor, stating that a landowner “owns at least as much of the space above the ground as he can occupy or use in connection with the land”. This has been a guiding principle of U.S. law for more than 70 years.

By 1958, Federal regulations evolved to clearly define navigable airspace to include everything that was 500 feet or more above ground level, along with “airspace needed to insure safety in take-off and landing of aircraft”.

The “ad coelum”, or to the sky, doctrine, “had no place in the modern world,” wrote Justice William Douglas in his Causby judgment in 1946, arguing there exists “public highway” in the sky which was part of the “public domain”.

Mackler said the current tensions over drones partly derived from the lack of clarity over the legality of their use.

“People have a visceral reaction to seeing a drone. Unmanned aircraft are something different, something they often don’t expect,” he said.

“But if you know that in advance that a drone is being used by your utility company to inspect the safety of the local power lines, you will be less fearful. Law and technology have always had this tension: it takes time, especially if it has to go through the courts. But it will work its way out.”

Drones emerge from shadows to become key cog in U.S. war machine

KANDAHAR, Afghanistan/CREECH AIR FORCE BASE, Nevada (Reuters) – When U.S. drones obliterated a car carrying Taliban leader Mullah Akhtar Mansour last month, it was the kind of targeted killing that unmanned aircraft are best known for.

But 15 years after a drone first fired missiles in combat, the U.S. military’s drone program has expanded far beyond specific strikes to become an everyday part of the war machine.

Now, from control booths in the United States and bases around the Middle East, Afghanistan and parts of Africa, drone crews are flying surveillance missions and providing close air support for troops on the ground.

“In the wars we fight, this is the future,” said drone pilot Lieutenant Shaw, as he stood in a hangar at the Air Force’s drone base in the southern Afghan city of Kandahar.

Crews spoke to Reuters on condition that only their first names and rank be used to identify them.

The increased use of Unmanned Aerial Vehicles (UAVs) in a wide range of battle applications comes as the United States looks to reduce the number of soldiers fighting abroad.

The U.S. military declined to provide statistics breaking down drone activity into types of missions, but dozens of interviews with people working in the secretive programs show UAVs have become an integral tool on the battlefield.

That is likely to raise further objections from critics who say drones often miss their intended targets, can only partly relay what is happening on the ground and encourage warfare with impunity waged by people at computer screens far from danger.

In Afghanistan, the United States has around 9,800 troops left and plans to cut the level to 5,500 by early 2017.

At its peak a few years ago, the U.S. military had around 100,000 soldiers there, yet the dramatic decrease does not mean the conflict is winding down. In fact, the Taliban insurgency is as potent now as at any time since 2001.

DRONES TAKING OVER

As part of its expanding program, the Air Force aims to double the number of drone squadrons over the next five years.

Even some proponents, like retired Lieutenant Colonel T. Mark McCurley, a former Air Force drone pilot, say over reliance on remote killing and electronic intelligence has hurt efforts on the ground.

“Too often, remotely piloted aircraft are being used as a tool to wantonly kill individuals, rather than as one of many tools to capture and shut down whole terrorist networks,” he said.

Central to the shift toward remote operations is Afghanistan, where weak local forces, a dwindling troop presence and rugged terrain have made it something of a testing ground.

Drones there log up to eight times as many flight hours as the few remaining manned fighter aircraft. They also release more weapons than conventional aircraft, Reuters reported in April.

For the first time, the top Air Force general in the country was trained as a drone pilot before he deployed, a move he said reflected the importance of unmanned aircraft in the broader military mission.

“Our airmen are flying persistent intelligence, surveillance, reconnaissance, and strike missions all across Afghanistan,” Major General Jeff Taliaferro told Reuters in Kabul, referring to the drone program.

“They’re performing everything from counterterrorism to base defense, and really it’s a capability a lot of our missions have come to rely on.”

RAPID EXPANSION

The latest generation of drones carries more and bigger weapons and an expanding payload of hi-tech sensors designed to handle a wider range of missions for the conventional military.

The number of hours flown by the Air Force’s newest attack drone, the MQ-9 Reaper, more than doubled globally between 2010 and 2015, to nearly as many hours as F-16 fighter jets, according to statistics from the Air Force Safety Center.

In a plan announced late last year, the Air Force proposed roughly $3 billion in funding to expand its attack drone force further, adding 75 of the latest Reaper aircraft.

It already fields at least 93 Reapers and 150 of the older MQ-1 Predators, both built by General Atomics, as well as 33 much larger Global Hawk surveillance UAVs, manufactured by Northrop Grumman.

The U.S. Army also operates a fleet of roughly 130 MQ-1C Gray Eagle unmanned aircraft, an upgraded version of the Predator, and all military services have thousands of smaller, mostly unarmed surveillance drones.

One challenge for the U.S. military is recruiting enough staff to operate a growing fleet and expanding range of roles.

As many as 3,500 new personnel may be added to a workforce of roughly 1,700 pilots and sensor operators in a bid to expand the program and relieve stress and overwork, according to proposals released by the Air Force’s Air Combat Command.

FULL CIRCLE

While Afghan missions are flown via satellite link by pilots at bases in the United States, aircraft take off and land under the control of crews deployed to the airfields in Afghanistan.

As a steady procession of Reapers rolled down the runways and into the bright Afghan sky, operators at Kandahar described life in on of the fastest-changing sectors of the military.

“My old job was going away, while this field is rapidly expanding,” said Captain Bryan, a pilot who used to fly KC-135 refueling aircraft.

Kandahar’s role as a drone center in Afghanistan brings the drone full circle.

Fifteen years ago, a U.S. drone made history over Kandahar when it fired the first weapon deployed by unmanned aircraft in combat, during a failed attempt to kill then-Taliban leader Mullah Omar in the first days of the U.S.-led operation that ousted the hardline Islamists from power.

On its way back to base, the drone fired its second missile at Kandahar airfield, then suspected of being occupied by Taliban and al Qaeda fighters.

At the height of the NATO coalition mission, Kandahar, which is also a civilian airport, hosted a range of military aircraft including F-16 fighter jets and C-130 cargo planes. Now, the only attack aircraft deployed here are about two dozen drones.

Squeezed into sand-colored shipping containers just off the tarmac, pilots and sensor operators flip through checklists amid an array of monitors, touch screens, radio consoles and a secret chat system with which they talk to pilots in the United States.

At the beginning of the year, the squadron at Kandahar began flying new, extended-range Reapers, usually carrying four Hellfire missiles, one 500 lb GBU-12 bomb and an external fuel tank under the wings.

That load has allowed the aircraft to be used for more than just hunting individuals, including close air support for troops fighting on the ground.

“ANYTHING BUT A VIDEO GAME”

Almost 8,000 miles away, pilots sitting at another sun-bleached desert base, this time in the United States, are among the crews that take over a few minutes after takeoff and guide the aircraft during the mission.

Sitting in dark, air-conditioned booths at Creech Air Force Base in Nevada, pilots and sensor operators work closely with large teams of intelligence analysts who sift streams of real-time data transmitted by the drones on the other side of the planet.

While air strikes often grab the headlines, the vast majority of missions in Afghanistan involve hours of mind-numbing surveillance and intelligence gathering, crews say.

The most revolutionary aspect of unmanned aircraft, crews add, is the combination of weapons and surveillance capabilities, which often provide more information than analysts can process.

At Creech, crews handle nearly half of all the Air Force’s 60 global drone flights on any given day.

“For us it’s anything but a video game,” said Captain Tim, a pilot based at Creech, addressing one of the main criticisms leveled at the drone program. “From here you’re having an impact on the battlefield.”
