The defense motions to acquit after the prosecution presents a case is common but rarely granted. Common Pleas Judge Jeffrey Minehart did not explain why he granted the motions. A witness in the Philadelphia Abortion House of Horrors trial testified that she saw the chests of babies moving and heard them making noises before Dr. Kermit Gosnell killed them.
Kareema Cross, the final prosecution witness, testified that she personally saw 10 babies breathe before they were killed. She also said that she saw three babies “move their arms and legs” and heard a fourth baby give out a soft whine before Gosnell killed them.
