WASHINGTON (Reuters) – Two U.S. Navy warships sailed near South China Sea islands claimed by China on Sunday, two U.S. officials told Reuters, in a move that drew condemnation from Beijing as President Donald Trump seeks its continued cooperation on North Korea.

The operation was the latest attempt to counter what Washington sees as Beijing’s efforts to limit freedom of navigation in the strategic waters.

While this operation had been planned months in advance, and similar operations have become routine, it comes at a particularly sensitive time and just days after the Pentagon uninvited China from a major U.S.-hosted naval drill.

The U.S. officials, speaking on condition of anonymity, said the Higgins guided-missile destroyer and the Antietam, a guided-missile cruiser, came within 12 nautical miles of the Paracel Islands, among a string of islets, reefs and shoals over which China has territorial disputes with its neighbors.

The U.S. military vessels carried out maneuvering operations near Tree, Lincoln, Triton and Woody islands in the Paracels, one of the officials said.

Trump’s cancellation of a summit with North Korean leader Kim Jong Un has put further strain on U.S.-China ties amid a trade dispute between the world’s two largest economies.

Critics of the operations, known as a “freedom of navigation,” have said that they have little impact on Chinese behavior and are largely symbolic.

The U.S. military has a long-standing position that its operations are carried out throughout the world, including in areas claimed by allies, and that they are separate from political considerations.

Satellite photographs taken on May 12 showed China appeared to have deployed truck-mounted surface-to-air missiles or anti-ship cruise missiles at Woody Island.

Earlier this month, China’s air force landed bombers on disputed islands and reefs in the South China Sea as part of a training exercise in the region, triggering concern from Vietnam and the Philippines.

The U.S. military did not directly comment on Sunday’s operation, but said U.S. forces operate in the region daily.

“We conduct routine and regular Freedom of Navigation Operations (FONOPs), as we have done in the past and will continue to do in the future,” U.S. Pacific Fleet said in a statement.

China’s Defense Ministry expressed its anger, saying it had sent ships and aircraft to warn the U.S. warships to leave, saying they had entered the country’s territorial waters without permission.

The move “contravened Chinese and relevant international law, seriously infringed upon Chinese sovereignty (and) harmed strategic mutual trust between the two militaries,” it said.

In a separate statement, China’s Foreign Ministry urged the United States to stop such actions.

“China will continue to take all necessary measures to defend the country’s sovereignty and security,” it added, without elaborating.

CONTESTED SEA

Pentagon officials have long complained that China has not been candid enough about its rapid military build-up and using South China Sea islands to gather intelligence in the region.

In March, a U.S. Navy destroyer carried out a “freedom of navigation” operation close to Mischief Reef in the Spratly Islands.

Chinese officials have accused Washington of viewing their country in suspicious, “Cold War” terms.

China’s claims in the South China Sea, through which about $5 trillion in shipborne trade passes each year, are contested by Brunei, Malaysia, the Philippines, Taiwan and Vietnam.

The United States has said it would like to see more international participation in freedom-of-navigation operations in the South China Sea.

China installs cruise missiles on South China Sea outposts: CNBC

WASHINGTON (Reuters) – China has installed anti-ship cruise missiles and surface-to-air missile systems on three of its outposts in the South China Sea, U.S. news network CNBC reported on Wednesday, citing sources with direct knowledge of U.S. intelligence reports.

The installations, if confirmed, would mark the first Chinese missile deployments in the Spratly Islands, where several Asian countries including Vietnam and Taiwan have rival claims.

China has made no mention of any missile deployments but says its military facilities in the Spratlys are purely defensive, and that it can do what it likes on its own territory.

China’s Defense Ministry did not immediately respond to a request for comment on the latest report.

The foreign ministry said China has irrefutable sovereignty over the Spratly Islands and that its necessary defensive deployments were for national security needs and not aimed at any country.

“Those who do not intend to be aggressive have no need to be worried or scared,” ministry spokeswoman Hua Chunying told reporters in Beijing.

China “hopes relevant parties can objectively and calmly view this”, she added.

CNBC quoted unnamed sources as saying that according to U.S. intelligence assessments, the missiles were moved to Fiery Cross Reef, Subi Reef and Mischief Reef within the past 30 days.

The U.S. Defense Department, which opposes China’s installation of military facilities on outposts it has built up in the South China Sea, declined comment. “We don’t comment on matters of intelligence,” a spokesman said.

Greg Poling, a South China Sea expert at Washington’s Center for Strategic and International Studies think-tank, said deploying missiles on the outposts would be important.

“These would be the first missiles in the Spratlys, either surface to air, or anti-ship,” he said.

He added that such deployments were expected as China built missile shelters on the reefs last year and already deployed such missile systems on Woody Island further to the north.

Poling said it would be a major step on China’s road to dominating the South China Sea, a key global trade route.

“Before this, if you were one of the other claimants … you knew that China was monitoring your every move. Now you will know that you’re operating inside Chinese missile range. That’s a pretty strong, if implicit, threat,” he said.

CNBC said the YJ-12B anti-ship cruise missiles allowed China to strike vessels within 295 nautical miles. It said the HQ-9B long-range, surface-to-air missiles could target aircraft, drones and cruise missiles within 160 nautical miles.

Last month, U.S. Admiral Philip Davidson, nominated to head U.S. Pacific Command, said China’s “forward operating bases” in the South China Sea appeared complete.

“The only thing lacking are the deployed forces,” he said. Once these were added, “China will be able to extend its influence thousands of miles to the south and project power deep into Oceania”.

Davidson said China could use the bases to challenge the U.S. regional presence, and “would easily overwhelm the military forces of any other South China Sea-claimants.

“China is now capable of controlling the South China Sea in all scenarios short of war with the United States,” he said.

ABOARD THE USS THEODORE ROOSEVELT, South China Sea (Reuters) – In a span of 20 minutes, 20 F-18 fighter jets took off and landed on the USS Theodore Roosevelt aircraft carrier, in a powerful display of military precision and efficiency.

The nuclear-powered warship, leading a carrier strike group, was conducting what the U.S. military called routine training in the disputed South China Sea on Tuesday, headed for a port call in the Philippines, a defence treaty ally.

The United States is not alone in carrying out naval patrols in the strategic waterway, where Chinese, Japanese and some Southeast Asian navies operate, possibly increasing tensions and risking accidents at sea.

“We have seen Chinese ships around us,” Rear Admiral Steve Koehler, the strike group commander, told a small group of reporters on board the three-decade-old carrier.

“They are one of the navies that operate in the South China Sea but I would tell you that we have seen nothing but professional work out of the ships we have encountered.”

Navies in the western Pacific, including China and nine Southeast Asian countries, have been working on a code of unexpected encounters (CUES) at sea to avoid conflict.

The USS Theodore Roosevelt’s presence in the South China Sea comes days after China’s massive air and naval drills in the area, in what some analysts described as an unusually large display of Beijing’s growing naval might.

China’s growing military presence in the waters has fueled concern in the West about Beijing’s end game.

The United States has criticized China’s apparent militarization of manmade islands and carried out regular air and naval patrols to assert its right to freedom of navigation in stretches of a sea China claims largely as its own.

“This transit in the South China Sea is nothing new in our planning cycle or in a reaction to that. It is probably by happenstance that all that is happening at the same time,” said Koehler, who gave a tour of the carrier to Philippine military officials and watched flight operations aboard the 100,000-tonne warship.

FUNCTION OF LAW

“All of the operations that we do in and around the South China Sea or any of the bodies of water we operate in, there is a function of international law and that is ultimately what we want to recognize,” Koehler said.

Tension between the United States and China over trade and territory under U.S. President Donald Trump has been stepped up of late, with fear in the region that the South China Sea, vital to global trade, could one day become a battleground between the two rival powers.

Philippine ties with China have meanwhile warmed under President Rodrigo Duterte, who has put aside disputes with Beijing and wants it to play a key role in building and funding urgently needed infrastructure, from highways and ports to railways and power plants.

China has long objected to U.S. military operations off its coasts, even in areas Washington insists are free to international passage.

“They (China) certainly have the right to exercise off their coast like we do, nor are they necessarily in charge of our transit cycle, but our deployment’s been planned,” Koehler said.

As the crew in color-coded uniforms raced to service dozens of aircraft taking off and landing, “handlers” in the flight deck control made sure the deck had enough room for jets to maneuver and refuel with the help of a “Ouija board”.

The board has all the models of each aircraft, which are marked with squadron name, model, make, and number of personnel. At any given moment, the flight deck is home to dozens of aircraft and helicopters.

“It is a showcase of the capability of the U.S. armed forces,” Philippine army chief Rolando Bautista said of the demonstration.

“Since Americans are our friends in one way or another, they can help us deter any threat.”

WASHINGTON/BEIJING (Reuters) – A U.S. Navy destroyer warship carried out a “freedom of navigation” operation on Friday, coming within 12 nautical miles of an artificial island built by China in the South China Sea, U.S. officials told Reuters.

The operation, which infuriated Beijing, was the latest attempt to counter what Washington sees as China’s efforts to limit freedom of navigation in the strategic waters.

The officials, speaking on condition of anonymity, said the destroyer Mustin traveled close to Mischief Reef in the Spratly Islands and carried out maneuvering operations. China has territorial disputes with its neighbors over the area.

The United States has criticized China’s construction of islands and buildup of military facilities in the area, and is concerned they could be used to restrict free nautical movement.

The latest operation, the first since January, occurred just a day after U.S. President Donald Trump lit a slow-burning fuse by signing a presidential memorandum that will target up to $60 billion in Chinese goods with tariffs, following a 30-day consultation period that starts once a list is published.

When asked about the latest operation, the U.S. military said its activities are carried out under international law and American forces operate in the region on a daily bases.

“We conduct routine and regular freedom of navigation operations, as we have done in the past and will continue to do in the future,” said Lieutenant Commander Nicole Schwegman, a spokeswoman for U.S. Pacific Fleet.

China’s Defense Ministry said two Chinese naval ships had been sent to identify the U.S. ship and warn it to leave.

It described the actions of the American ship as seriously harming China’s sovereignty and security, which threatens regional peace and stability.

Such actions cause forces from both countries to come into close proximity and could easily cause a misjudgment or accident, and create serious political and military provocation for China, it added.

China has always dedicated itself to protecting freedom of navigation and overflight in the South China Sea, but opposes “illegal and provocative” moves in the name of freedom of navigation, it said.

“We demand the U.S. side earnestly respects China’s sovereignty and security and the strong wishes of countries in the region to protect peace, stability and tranquility, and not make trouble out of nothing and stir up havoc,” it said.

“The provocative behavior by the U.S. side will only cause the Chinese military to further strengthen building up defense abilities in all areas.”

“MANUFACTURING TENSIONS”

In a separate statement, China’s Foreign Ministry said the country would continue to take all necessary steps to protect its sovereignty and peace and stability in the South China Sea, where it said the situation was developing for the better with the hard work of China and Southeast Asian nations.

The U.S. determination to “manufacture tensions” flies in the face of the wishes of countries in the region to seek cooperation and development and will not enjoy popular support, the ministry added.

The U.S. military has a longstanding position that its operations are carried out throughout the world, including in areas claimed by allies, and they are separate from political considerations.

China’s claims in the South China Sea, through which about $5 trillion in ship-borne trade passes each year, are contested by Brunei, Malaysia, the Philippines, Taiwan and Vietnam.

The U.S. military put countering China and Russia at the center of a new national defense strategy unveiled in January.

China’s navy will carry out combat drills in the South China Sea, the military’s official newspaper said on Friday, calling the move part of regular annual exercises.

Taiwan’s Defense Ministry said on Wednesday it had shadowed a Chinese aircraft carrier group traversing the Taiwan Strait in a southwesterly direction – meaning into the disputed South China Sea – in what Taiwan judged to be a drill.

The United States has been pushing allies to carry out freedom of navigation operations as well.

Britain last month said one of its warships would pass through the South China Sea to assert freedom-of-navigation rights.

Record number of U.S. Marines to train in Australia in symbolic challenge to China

SYDNEY (Reuters) – The United States will deploy a record number of Marines to train in Australia, the Australian defense minister said on Friday, as Washington seeks to counter what it describes as Chinese aggression in the region.

Payne said 1,587 U.S. Marines will spend six months training in Australia’s remote north, an increase of nearly 27 percent on its 2017 rotation for the program known as the Force Posture Initiatives.

“The U.S. military plays a vital role in underwriting security and stability across the Indo-Pacific, and the Force Posture Initiatives will be an essential component in preserving stability and security over the coming decades,” Defence Minister Marise Payne said in a statement.

The deployment, first introduced in 2011 as part of a U.S. “pivot” to Asia, has emerged as a key indicator of Washington’s commitment to the region under U.S. President Donald Trump and his willingness to counter Chinese influence in a region where tensions have spiked amid disputes over the South China Sea.

China claims most of the South China Sea, an important trade route that is also believed to contain large quantities of oil and natural gas, and has been building artificial islands on reefs, some with ports and air strips.

In a move likely to irk Beijing, the U.S. Marines will train with personnel from Australia, Indonesia, Japan, Malaysia, the Philippines, Singapore and Thailand, some of which also have claims in the South China Sea.

“China will monitor whatever the U.S. does and it would prefer that the United States not work with the Asian countries included in these exercises,” said Euan Graham, director of the international security program at Australian think tank the Lowy Institute.

“Beijing would like to deal one-on-one with Southeast Asia nations that have counter claims,” he said.

The U.S. Marines will also bring additional military equipment, including helicopters and F-18 jets, Payne said.

The military deployment also threatens to further weaken Australia-Chinese relations.

Australia, a staunch U.S. ally with no claim to the South China Sea, has long maintained its neutrality in the dispute to protect its economic relationship with China.

But bilateral relations have soured in recent months after Australian Prime Minister Malcolm Turnbull said China was improperly interfering in Canberra’s affairs, an accusation that triggered a rare protest from Beijing.

HONG KONG/BEIJING (Reuters) – While the Pentagon plays down patrols close to Chinese-controlled reefs and islands in the South China Sea, Beijing is sounding the alarm about them, seeking to justify what experts say will be an even greater presence in the disputed region.

Chinese officials publicized the latest U.S. “freedom of navigation patrol”, protesting the deployment last week of the destroyer USS Hopper to within 12 nautical miles of Scarborough Shoal, an atoll west of the Philippines which Beijing disputes with Manila.

It was the second time in recent months that confirmation of a patrol came from Beijing, not Washington, which had previously announced or leaked details.

Bonnie Glaser, a security expert at Washington’s Center for Strategic and International Studies, said while the administration of U.S. President Donald Trump had a policy of keeping the patrols regular but low key, China was willing to publicly exploit them to further their military ends.

“It is difficult to conclude otherwise,” she said. “Even as it pushes ahead with these (patrols), I don’t think the Trump administration has really come to terms with what it will tolerate from China in the South China Sea, and what it simply won’t accept, and Beijing seems to grasp this.”

In official statements, Chinese foreign ministry official Lu Kang said China would take “necessary measures to firmly safeguard its sovereignty” in the resource-rich sea.

Some regional diplomats and security analysts believe that will involve increased Chinese deployments and the quicker militarization of China’s expanded facilities across the Spratlys archipelago.

While U.S. officials did not target China in their comments, couching freedom-of-navigation patrols as a “routine” assertions of international law, Beijing was quick to cast Washington as the provocateur.

The Communist Party’s official People’s Daily newspaper on Monday accused the U.S. of upsetting recent peace and co-operation and “wantonly provoking trouble”, saying China had must now strengthen its presence in the strategic waterway.

CONSTRUCTION AND MILITARIZATION

In recent years, China has built up several reefs and islets into large-scale airstrips and bases as it seeks to assert and enforce its claims to much of the sea, through which some $3 trillion in trade passes annually. The Philippines, Vietnam, Malaysia and Brunei, as well as Taiwan, hold rival claims.

Chinese coastguard and People’s Liberation Army navy ships patrol vast swathes of the South China Sea, routinely shadowing U.S. and other international naval deployments, regional naval officers say.

Zhang Baohui, a mainland security analyst at Hong Kong’s Lingnan University, told Reuters he believed Beijing was rattled by Trump’s sharpening Asia strategy and they might be tempted to react in the South China Sea, even after months of relative calm.

“We can perhaps expect the Chinese to push ahead with militarization as retaliation,” he said.

A new U.S. national defense strategy unveiled last week stressed the need to counter the rising authoritarian powers of China and Russia, outlining a need to better support allies and newer partners against coercion.

While most analysts and regional envoys believe China remains keen to avoid an actual conflict with the significantly more powerful U.S. navy in the South China Sea, it is working to close the gap.

China has added bunkers, hangars and advanced radars on its new runways in the Spratlys, although it has not fully equipped them with the advanced surface-to-air and anti-ship missiles they use to protect the Paracels grouping further north.

Similarly, Beijing has yet to land jet fighters in the Spratlys – test flights some experts are expecting this year.

POTENTIAL FLASHPOINT

The latest patrol was at least the fifth such patrol under the Trump administration and the first to Scarborough – one of the more contentious features in the region.

Scarborough, once a U.S. bombing range, was blockaded by the Chinese in 2012, prompting the Philippines to launch its successful legal case in the Hague against China’s excessive territorial claims.

China allowed Filipino fishermen back to Scarborough’s rich waters last year, but it remains a potential flashpoint as both sides claim sovereignty and China maintains a steady presence of ships nearby.

While experts and regional envoys expect China to ramp up operations from the Spratlys, none expect it to build on Scarborough – something widely believed to be a red line that would provoke the United States, given its long-standing security treaty with the Philippines.

Shi Yinhong, who heads the Center for American Studies at Beijing’s Renmin University, said China had “lived with” U.S. patrols for several years but the key facts on the ground remained in China’s favor and broader tensions had “improved remarkably”.

“These islands, especially those with reclaimed land and military capability already deployed, they’re still in Chinese hands,” Shi, who has advised the Chinese government on diplomacy, told Reuters.

“I don’t think Trump has the stomach and the guts to change this fundamental status quo.”

Philippines to protest to China over apparent airbase on manmade island

MANILA (Reuters) – The Philippines will make a diplomatic protest to China, which the southeast Asian nation’s defense minister described as having reneged on a promise not to militarize artificial islands in the busy South China Sea waterway.

The United States has criticized China’s build-up of military facilities on the artificial islands and is concerned they could be used to restrict free movement along the key trade route.

Philippine Defence Secretary Delfin Lorenzana’s comment followed a Dec. 30 broadcast of aerial footage by the official China Central Television (CCTV) showing Fiery Cross Reef, which appeared to have been transformed into an airbase.

“The Chinese government said some time ago that they were not going to militarize those reclaimed islands,” Lorenzana told reporters, adding that the protest would be made through the foreign ministry.

“If it is true and we can prove that they have been putting soldiers and even weapons systems, that will be a violation of what they said.”

Asked about the protest, China’s foreign ministry spokesman said the construction was on the country’s territory and was intended to aid peace in the region, as well as maritime safety and disaster prevention.

“Of course, China also needs to construct necessary defense equipment for its territory,” the spokesman, Lu Kang, told a regular briefing on Tuesday. “The relevant equipment is not directed at any particular country.”

China and the Philippines have long sparred over the South China Sea, but relations have improved considerably under President Rodrigo Duterte, who has been courting Beijing in hopes of winning business and investment.

China has assured the Philippines it will not occupy new features or territory in the South China Sea, under a new “status quo” brokered by Manila as both sides try to strengthen their relations.

Reports about China militarizing reclaimed islands were not new, presidential spokesman Harry Roque told a regular news briefing.

“We have always been against the militarization of the area,” he added. “It is certainly not OK, because it constitutes a further threat to peace and security in area.”

China is holding to a commitment not to reclaim more islands, Roque added, however.

“There is still no breach of the good faith obligation for as long as China has not embarked on new reclamation,” he said, when asked about the situation on the reef.

China has denied U.S. charges that it is militarizing the South China Sea, which also is claimed by Brunei, Malaysia, the Philippines, Taiwan and Vietnam.

The reef has a hospital with more than 50 doctors, high-speed mobile connections and an airport with a runway of 3,160 meters (3,456 yards) to serve what Beijing calls a “weather station” equipped with radar, Chinese state media say.

In the last 27 years, China’s navy has sent more than 1,000 soldiers to guard the reef, state media have said.

WASHINGTON (Reuters) – While attention in Asia has been distracted by the North Korean nuclear crisis in the past year, China has continued to install high-frequency radar and other facilities that can be used for military purposes on its man-made islands in the South China Sea, a U.S. think tank said on Thursday.

Chinese activity has involved work on facilities covering 72 acres (29 hectares) of the Spratly and Paracel islands, territory contested with several other Asian nations, according to the Asia Maritime Transparency Initiative of Washington’s Center for Strategic and International Studies. The report cited satellite images.

The United States and its allies oppose China’s building of artificial islands in the South China Sea and their militarization, given concerns Beijing plans to use them to deny access to strategic routes.

“It’s completely normal for China to conduct peaceful construction and build essential defense equipment on its own sovereign territory,” China’s foreign ministry spokesman Lu Kang told a regular press briefing on Friday, in response to a question about the report.

“We believe certain people who have ulterior motives are making mountains out of molehills and stirring up trouble.”

The report said that in the last several months China had constructed what appeared to be a new high-frequency radar array at the northern end of Fiery Cross Reef in the Spratlys.

Subi Reef had seen tunnels completed that were likely for ammunition storage and another radar antenna array and radar domes, the report said.

Construction on Mischief Reef included underground storage for ammunition and hangars, missile shelters and radar arrays.

Smaller-scale work had continued in the Paracel Islands, including a new helipad and wind turbines on Tree Island and two large radar towers on Triton Island.

It said the latter were especially important as waters around Triton had been the scene of recent incidents between China and Vietnam and multiple U.S. freedom-of-navigation operations, which the U.S. navy has used to assert what it sees as its right to free passage in international waters.

Woody Island, China’s military and administrative headquarters in the South China Sea, saw two first-time air deployments “that hint at things to come at the three Spratly Island air bases farther south,” the report said.

At the end of October, the Chinese military released images showing J-11B fighters at Woody Island for exercises, while on Nov. 15, AMTI spotted what appeared to be Y-8 transport planes, a type that can be configured for electronic surveillance.

The Pentagon has conducted several patrols near Chinese-held South China Sea territory this year, even as it has sought China’s help in northeast Asia to press North Korea to give up its nuclear weapons program.

On Tuesday, U.S. Secretary of State Rex Tillerson reiterated a call for a “freeze” in China’s island building and said it was unacceptable to continue their militarization.

China, Philippines agree to avoid force in South China Sea dispute

BEIJING/MANILA (Reuters) – China and the Philippines have agreed to avoid force to resolve their differences over the South China Sea, according to a joint statement issued on Thursday by China at the end of a visit to Manila by Chinese Premier Li Keqiang.

China and the Philippines have long sparred over the South China Sea, but relations have improved considerably under Philippine President Rodrigo Duterte.

Malaysia, Taiwan, Brunei, Vietnam and the Philippines claim some or all of the South China Sea and its myriad shoals, reefs and islands. China claims most of the waterway and has been aggressively building and militarizing artificial islands.

The joint statement, carried by China’s official Xinhua news agency, said China and the Philippines reaffirmed the importance of peace in the South China Sea and of freedom of navigation and overflight.

There should be no violence or threats of violence and the dispute should be resolved via talks between the “relevant sovereign countries”, it added.

“Both sides believe that the maritime dispute is not the full sum of the China-Philippines relationship,” the statement said.

In a separate statement summing up discussions at the Association of Southeast Asian Nations summit, Duterte took note of the “improving relations between ASEAN and China” in the South China Sea.

“In view of this positive momentum, we looked forward to the announcement of the start of substantive negotiations on the Code of Conduct (COC) with China” he said, hopefully in early 2018 in Vietnam, where the two sides will meet at the earliest.

ASEAN and China have been discussing a set of rules on how to behave in the disputed waters to avoid accidents and raising tension.

Duterte said the two sides also had successfully tested the hotline among foreign ministries on how to manage maritime emergencies.

“In our view, these are practical measures that could reduce tensions, and the risks of accidents, misunderstandings and miscalculation,” he said.

South China Sea code of conduct talks to be 'stabilizer' for region: China premier

MANILA (Reuters) – China’s agreement to begin discussions with the Association of Southeast Asian Nations (ASEAN) on the fine print of a code of conduct framework for the disputed South China Sea will be a “stabilizer” for the region, Chinese Premier Li Keqiang said.

“China’s greatest hope is for peace and stability in the South China Sea,” Li told ASEAN leaders in Manila.

Southeast Asia and China foreign ministers in August adopted a negotiating framework for a code of conduct in the South China Sea, a move they hailed as progress but seen by critics as a tactic to buy China time to consolidate its maritime power.

Li, addressing leaders of ASEAN grouping during a summit in the Philippines capital Manila on Monday, said there was a consensus on moving forward and to try to peacefully resolve the thorny issue.

“We hope the talks on the code of conduct will bolster mutual understanding and trust. We will strive under the agreement, to reach a consensus on achieving early implementation of the code of conduct,” Li said, according to a transcript of his speech released by China’s Foreign Ministry on Tuesday.

Li didn’t give a timeframe, but said he hoped this move would be a “stabilizer” for the region.

Critics say the agreement to talk on the details of the code of conduct is only an incremental move, with a final agreement not likely anytime soon. Despite a period of relative stability in the South China Sea, some countries at the summit said this shouldn’t be taken for granted.

The framework seeks to advance a 2002 Declaration of Conduct (DOC) of Parties in the South China Sea, which has mostly been ignored by claimant states, particularly China, which has built seven manmade islands in disputed waters, three of which are equipped with runways, surface-to-air missiles and radars.

All parties say the framework is only an outline for how the code will be established but critics say the failure to outline as an initial objective the need to make the code legally binding and enforceable, or have a dispute resolution mechanism, raises doubts about how effective the pact will be.

Signing China up to a legally binding and enforceable code for the strategic waterway has long been a goal for claimant members of ASEAN, some of which have sparred for years over what they see as China’s disregard for their sovereign rights and its blocking of fishermen and energy exploration efforts.

Malaysia, Taiwan, Brunei, Vietnam and the Philippines all claim some or all of the South China Sea and its myriad shoals, reefs and islands.
