‘Loss and pain’: Families testify at Dutch MH17 trial

AMSTERDAM (Reuters) -A woman whose daughter was among 298 people who died when a Malaysia Airlines jet was shot down over Ukraine said on Friday she wanted to look the suspects in the eye and “make them feel our loss and pain.”

Relatives of the victims of flight MH17, brought down over rebel-held eastern Ukraine in 2014, denounced the “senseless and brutal” deaths of their loved ones during the trial of four suspects accused in the disaster.

Their testimony concluded three weeks of statements from 90 relatives from eight countries. They told the judges about the impact of the loss on their lives and their hopes for justice.

Prosecutor Alwin Dam said many relatives have issues with the “amount of misinformation and conspiracy theories that are spread about MH17” and the fact that no one has claimed responsibility.

The plane was flying from Amsterdam to Kuala Lumpur when it was hit by what international investigators and prosecutors say was a Russian surface-to-air missile.

Jeanne Hornikx’s daughter Astrid, 31, and Astrid’s partner Bart, 40, were among those on board.

Hornikx showed the judges a tattoo of her daughter’s fingerprint, saying “that is how she was identified”.

“I would like to look the suspects straight in the eye and make them feel our loss and pain. That our suffering becomes their suffering, that maybe grief shared – and remorse – can become grief halved,” Hornikx said.

Dutch prosecutors have brought charges against three Russians and a Ukrainian citizen, all suspected of having key roles in transporting the missile system. They went on trial for murder last year.

Two-thirds of the victims were Dutch citizens and the Netherlands blames Moscow for the attack.

Russia, which maintains that it has not funded or supported pro-Russian rebels fighting Ukrainian government troops, has refused to extradite the suspects. Only one defendant has appointed a lawyer.

The court adjourned until November with the prosecution closing statement expected on Nov. 15, judges said. A verdict will likely be handed down late next year.

Dutch government says it disrupted Russian attempt to hack chemical weapons watchdog

THE HAGUE (Reuters) – Dutch authorities disrupted an attempt in April by Russian intelligence agents to hack the Organization for the Prohibition of Chemical Weapons, Defence Minister Ank Bijleveld said on Thursday.

At a news conference in The Hague, Bijleveld called on Russia to cease its cyber activities aimed at “undermining” Western democracies.

She noted that the U.S. Department of Justice is expected to issue indictments of suspected Russian spies later on Thursday, in part due to information gleaned from the Dutch operation.

According to a presentation by the head of the Netherlands’ military intelligence agency, four Russians arrived in the Netherlands on April 10 and were caught on the 13th with spying equipment at a hotel next to the OPCW headquarters.

The men were not successful in breaching OPCW systems, the minister said.

At a presentation, Dutch Major General Onno Eichelsheim showed the antennae, laptops and other equipment the men intended to use to breach the OPCW’s wifi network. He said the spies were caught red-handed and attempted to destroy some of their own equipment to conceal what they had been doing.

At the time, the OPCW was working to verify the identity of the substance used in the March attack in Salisbury, Britain, on former Russian spy Sergei Skripal and his daughter Yulia. It was also seeking to verify the identity of a substance used in an attack in Douma, Syria.

The four Russians in the Netherlands were detained in April and expelled to Russia and not immediately prosecuted because the operation was considered military, not police, Eichelsheim said.

The men, who were also believed to have spied on the investigation into the 2014 downing of Malaysia Airlines flight MH17 had planned to travel on from the Netherlands to a laboratory in Spiez, Switzerland used by the OPCW to analyze chemical weapons samples, he said.

They were instead “put on a flight to Moscow,” said Bijleveld.

Eichelsheim warned against being naive and considering the Netherlands as relatively safe from Russian cyber attacks.

Russian military intelligence “is active here in the Netherlands … where a lot of international organizations are (based),” Eichelsheim said.

BUNNIK, Netherlands (Reuters) – Dutch prosecutors identified a Russian military unit on Thursday as the source of the missile that shot down Malaysia Airlines Flight 17 over eastern Ukraine in 2014, killing all 296 people on board.

The airliner flying from Amsterdam to Kuala Lumpur was hit by a Russian-made “Buk” anti-aircraft missile on July 17, 2014 over territory held by pro-Russian separatists. There were no survivors. Two thirds of those killed were Dutch.

“The Buk that was used came from the Russian army, the 53rd brigade,” Chief Dutch Prosecutor Fred Westerbeke told Reuters. “We know that was used, but the people in charge of this Buk, we don’t know.”

Investigators appealed to the public to come forward and help identify members of the crew who operated the missile and determine how high up the chain of command the order originated.

“The Russian Federation didn’t help us in providing us the information we brought out into the open today,” Westerbeke said. “They didn’t give us this information, although a Buk from their military forces was used.”

Russia repeated on Thursday that it had nothing to do with the incident.

“Not a single air defense missile launcher of the Russian Armed Forces has ever crossed the Russian-Ukrainian border,” Russia’s TASS news agency quoted the Defense Ministry as saying in a statement.

Prosecutors showed photos and videos of a truck convoy carrying the system as it crossed the border from Russia to Ukraine. It crossed back several days later with one missile missing. The vehicles had serial numbers and other markings that were unique to the 53rd brigade, an anti-aircraft unit based in the western Russian city of Kursk, they said.

In the interim update on their investigation, prosecutors said they had trimmed their list of possible suspects from more than a hundred to several dozen.

Westerbeke said investigators were not yet ready to identify individual suspects publicly or to issue indictments, but that when they do he expects cooperation, or a firm international political response.

HOLD RUSSIA ACCOUNTABLE

Dutch Prime Minister Mark Rutte cut short a trip to India to return in time for a cabinet meeting on Friday to discuss the latest findings in the inquiry.

The MH17 Disaster Foundation representing families of the victims demanded that the Dutch government take legal action to hold the Russian state accountable.

“It must go beyond legal exploration after this,” board member Piet Ploeg was quoted by the NOS broadcaster as saying.

A Joint Investigation Team, drawn from Australia, Belgium, Malaysia, the Netherlands and Ukraine, is gathering evidence for a criminal prosecution in the downing of the plane.

Ukrainian Army General Vasyl Hrytsak, a member of the investigation team, told Reuters the next crucial step would be to pinpoint who issued the orders to move the missile system.

The Dutch Safety Board concluded in an October 2015 report that the Boeing 777 was struck by a Russian-made Buk missile.

Malaysia to pay U.S. firm up to $70 million if it finds missing MH370

KUALA LUMPUR (Reuters) – Malaysia signed a deal on Wednesday to pay a U.S. seabed exploration firm up to $70 million if it finds the missing Malaysia Airlines aircraft MH370 within 90 days of embarking on a new search in the Southern Indian ocean.

The disappearance of the aircraft en route from Kuala Lumpur to Beijing in March 2014 with 239 people aboard ranks among the world’s greatest aviation mysteries.

Australia, China and Malaysia ended a fruitless A$200-million ($157 million) search of a 120,000 sq. km area in January last year, despite investigators urging the search be extended to a 25,000-square-km area further to the north.

Malaysian Transport Minister Liow Tiong Lai said a Houston-based private firm, Ocean Infinity, would search for MH370 in that 25,000-sq-km priority area on a “no-cure, no-fee” basis, meaning it will only get paid if it finds the plane.

“As we speak, the vessel, Seabed Constructor, is on her way to the search area, taking advantage of favorable weather conditions in the South Indian ocean,” Liow told a news conference.

The search will begin on Jan. 17, said Ocean Infinity Chief Executive Oliver Plunkett, who attended the signing event.

Ocean Infinity will be paid $20 million if the plane is found within 5,000 sq km, $30 million if it is found within 10,000 square km and $50 million if it is found within an area of 25,000 square km. Beyond that area, Ocean Infinity will receive $70 million, Liow said.

Its priority is to locate the wreckage or the flight and cockpit recorders, and present credible evidence to confirm their location within 90 days, Liow added.

“They cannot take forever or drag it on for another six months or a year.”

‘UNIQUE SOLUTION’

Ocean Infinity’s vessel carries eight autonomous underwater vehicles that will scour the seabed with scanning equipment for information to be sent back for analysis.

It has 65 crew, including two government representatives drawn from the Malaysian navy.

The ship could complete the search within three or four weeks, and cover up to 60,000 square km in 90 days, or four times faster than earlier efforts, Plunkett told Reuters.

“It was a unique problem that required a unique solution… We looked at it and said, ‘Let’s do something different than what other people would do,’ and that’s the essence of our business.”

Ocean Infinity’s core business is in the oil and gas industry, as well as subsea exploration services for tasks such as underwater cabling and seabed mapping, he said.

The company’s shareholders would bear the upfront costs of the search, Plunkett added.

Debris from MH370 could provide clues to events on board before the crash. There have been competing theories that the aircraft suffered mechanical failure or was intentionally flown off course.

Investigators believe someone may have deliberately switched off the plane’s transponder before diverting it thousands of miles out over the Indian Ocean.

At least three pieces of debris collected from sites on Indian Ocean islands and along Africa’s east coast have been confirmed as being from the missing plane.

U.S. firm Ocean Infinity says hopeful of getting MH370 search contract soon

KUALA LUMPUR (Reuters) – U.S.-based seabed exploration firm Ocean Infinity on Wednesday said it was moving a vessel closer to a possible search area for missing Malaysia Airlines flight MH370 as it soon expects to be awarded a contract by Malaysia to resume the search.

The disappearance of the aircraft en route from Kuala Lumpur to Beijing in March 2014 with 239 people aboard ranks among the world’s greatest aviation mysteries. Australia, China and Malaysia ended a fruitless A$200-million ($156.62 million) search in January last year.

But in October, Malaysia said it was in talks with Ocean Infinity to resume the search on a “no-cure, no-fee” basis, meaning it will only get paid if it finds the plane.

“Ocean Infinity is hopeful of receiving the final contract award for the resumption of the search for MH370 over the coming days,” a company spokesman told Reuters in an emailed statement.

“With a relatively narrow weather window, we are moving the vessel, Seabed Constructor, towards the vicinity of the possible search zone. This is designed to save time should the contract award be forthcoming, as hoped,” he said.

Reuters shipping data showed the Seabed Constructor left Durban, South Africa, on Tuesday and was headed to Perth, Australia, where it is due on Feb. 7.

Malaysia’s deputy transport minister, Aziz Kaprawi, said the government was negotiating final terms of the agreement with Ocean Infinity and he was not aware of the vessel’s movement.

“We are in the final stages of the decision. On our part, we have yet to finalize the agreement,” he told Reuters.

When asked whether Australia and China would be consulted about the contract award, Aziz said: “Basically, Malaysia will make the decision, as this offer was made to the Malaysian government. The cost will also be decided by Malaysia.”

Various pieces of debris have been collected from Indian Ocean islands and Africa’s east coast and at least three of them have been confirmed as coming from the missing plane.

MH370 families launch campaign to fund search for the missing jet

KUALA LUMPUR (Reuters) – Families of passengers on board missing Malaysia Airlines flight MH370 on Saturday launched a campaign to privately fund a search for the aircraft.

Flight MH370, carrying 239 people, went missing on its way from Kuala Lumpur to Beijing, nearly three years ago, on March 8, 2014.

Australia, Malaysia, and China jointly called off a two-year underwater search for the aircraft in January.

Grace Nathan, a Malaysian lawyer whose mother, Anne Daisy, was on the plane, said the families hope to raise $15 million to fund an initial search north of the previous search area.

“We won’t start fundraising until we’re sure that the governments are not going to resume the search and until the current data has been fully reviewed and analyzed,” she said at the campaign launch and MH370 memorial event held at a mall in Kuala Lumpur.

The three governments have said they will resume the search if any credible evidence on the whereabouts of the plane emerges.

International experts last year assisted Voice 370, a support group for MH370 next-of-kin, in mounting their own search along the East African coast where debris had been discovered.

“They pinpointed to us accurately where the debris would have made landfall. They’ve been very helpful both on a personal level and to the investigation,” Grace said.

The memorial event, the first held since the search was suspended, featured musical and dance performances, while family members and friends of those aboard made impassioned pleas for the search to continue.

Jiang Hui, whose mother was on the plane, recounted his experience discovering a piece of potential MH370 debris in Madagascar last year.

“I thought it was very miraculous and fortunate when I found the piece of debris that day, but I thought it was useless because this sort of searching activity should have been done by the government,” said Jiang, who traveled from China to attend the memorial.

“It should not be us, the family members, who should have been subjected to this pain, to go and face this cruel reality.”

Malaysian Transport Minister Liow Tiong Lai, who attended the event, said authorities had analyzed 27 pieces of potential MH370 debris along the East African coastline, including two new pieces found in South Africa two weeks ago.

The government has also signed several agreements with countries along the East African coastline to coordinate searches for debris, Liow said.
