Strong retail sales boost optimism before U.S. election, but it may be short lived

(Reuters) – In an ordinary presidential election, Friday’s retail sales report would have been a dream for an incumbent like Republican President Donald Trump. Headline sales topped expectations by a wide margin and spending was up from August in all but one of the major categories.

Still, this is no ordinary election. Despite the gains seen in September, spending in key sectors that suffered massive job losses during the pandemic, such as restaurants and clothing stores, remain deeply below last year’s levels.

The report from the Commerce Department offered a reminder that millions of Americans are still out of work, leaving them with less money to spend on dinners out or new outfits. Without a vaccine or effective treatment, many consumers also hesitate to head out to stores or restaurants where they may be exposed to the virus.

On the one hand, the retail report showed that overall retail spending is now above pre-pandemic levels. That is a sign that some people may have spent the $300 supplement the federal government temporarily added to unemployment benefits. Other people may have boosted spending after being called back to work.

If more people continue to see their finances improve, that could bode well for the economy and for the overall outlook people carry when they vote in the Nov. 3 election.

But some economists are also questioning whether the increase in spending seen in September will continue with virus infections rising, job growth stalling and government aid fading.

Enhanced unemployment benefits and direct cash payments distributed as part of the CARES Act made it possible for jobless Americans to boost spending and pad their savings. But much of those savings were spent in August after the supplement to unemployment benefits expired, according to a study released Friday by the JPMorgan Chase Institute.

The White House and Congress have yet to reach a deal on another package. Job growth is also slowing and the number of Americans filing new claims for jobless benefits reached a two-month high last week.

“The progress we’ve made, which has been better than expected, may be slowing,” said John Briggs, head of strategy for the Americas at NatWest Markets. “I don’t know how much it hurts Trump’s chances, but I don’t see how it can help him.”

Exclusive: Hackers test defenses of Trump campaign websites ahead of U.S. election, security staff warn

LONDON (Reuters) – Hackers have stepped up efforts to knock Trump campaign and business websites offline ahead of the U.S. election, in what a security firm working for the campaign said could be preparation for a larger digital assault, according to emails seen by Reuters.

The security assessment was prepared by staff at U.S. cybersecurity firm Cloudflare, which has been hired by President Donald Trump to help defend his campaign’s websites in an election contest overshadowed by warnings about hacking, disinformation and foreign interference.

Cloudflare is widely used by businesses and other organizations to help defend against distributed denial-of-service (DDoS) attacks, which aim to take down websites by flooding them with malicious traffic.

Internal Cloudflare emails sent to senior company managers – including CEO Matthew Prince – on July 9 state that the number and severity of attacks on Trump websites increased in the preceding two months and reached record levels in June. The emails did not give the total number of attacks.

“As we get closer to the election, attacks are increasing in both numbers (and) sophistication” and succeeded in disrupting access to the targeted websites for short periods of time between March 15 and June 6, the assessment said.

Cloudflare did not respond directly to questions about the emails or their contents. The company said it was providing security services to both U.S. presidential campaigns and declined to answer further questions about the nature or details of its work.

“We have seen an increase in cyber attacks targeting political candidates. We will continue to work to ensure these attacks do not disrupt free and fair elections,” it said in a statement when asked about the emails.

A spokesman for the Trump campaign did not respond to a request for comment. The Biden campaign declined to comment on its work with Cloudflare or any attacks on its websites.

A spokeswoman for the Trump Organization said no Trump websites had been taken offline by cyber attacks. She did not respond to further questions about the attacks or Trump’s work with Cloudflare.

Cloudflare’s security team did not comment on the identity of the hackers and Reuters was not able to determine who was responsible for the attacks.

DDoS attacks are viewed by cybersecurity experts as a relatively crude form of digital sabotage – easily deployed by anyone from tech-savvy teenagers to top-end cyber criminals.

But seven of the attacks on Trump websites, including donaldjtrump.com and a Trump-owned golf course, were judged to be more serious by the Cloudflare security team, the emails show.

The increasing number and sophistication of attempts suggested the attackers were “probing” the website defenses to establish what would be needed to take them fully offline, the security assessment said.

“We therefore cannot discount the possibility that there are attackers using this as an opportunity to collect information for more sophisticated attacks,” it added.

The Cloudflare team said they would continue to monitor the attacks and carry out “a further round of security hardening” to better protect the websites.

U.S. House votes to block Postal reforms seen as threat to mail-in ballots

WASHINGTON (Reuters) – The Democratic-led U.S. House of Representatives voted on Saturday to provide the cash-strapped Postal Service with $25 billion and block policy changes that have stirred concerns about mail-in balloting ahead of the Nov. 3 election.

The 257-150 vote sent the legislation dubbed the “Delivering for America Act” on to the Republican-controlled Senate. But Senate Majority Leader Mitch McConnell said in a statement that the Senate would “absolutely not pass” the stand-alone bill.

The White House also strongly opposes the legislation and has said it would recommend that President Donald Trump veto the measure.

But more than two-dozen House Republicans broke ranks to join Democrats in approving the bill, during a rare Saturday session called by House Speaker Nancy Pelosi in the middle of the congressional August recess.

With mail-in voting expected to surge during the coronavirus pandemic, Trump has alarmed Democrats by repeatedly denouncing mail-in ballots as a possible source of fraud. Postmaster General Louis DeJoy recently suspended cost-cutting measures that have slowed deliveries in recent weeks.

Democrats, who accuse Trump of trying to discourage mail-in balloting to gain an electoral advantage over Democratic presidential nominee Joe Biden, cast themselves as defenders of a public that relies on the Postal Service for vital deliveries, including prescription drugs.

“The American people do not want anyone messing with the Post Office. They certainly do not want it to be politicized. They just want their mail, they want their medicines and they want their mail-in ballots delivered in a timely way. And that is exactly what our bill does,” said Democratic Representative Carolyn Maloney, who authored the legislation.

Maloney also released a Postal Service document showing an 8% slowdown in the processing of first class mail, most of it occurring after DeJoy became postmaster in June.

Republican leaders denied that the Postal Service was in any danger and criticized Democrats for moving legislation forward before DeJoy could testify at a House hearing slated for Monday.

“This is the result of a legislative process only slightly less absurd than the conspiracies, insinuations and fabrications that gave rise to the purported need for it,” said Republican Representative James Comer.

The 26 Republicans who supported the measure represented more than one in 10 House Republican members. Another 23 Republicans did not vote.

As lawmakers prepared to vote, Trump took to Twitter to accuse Pelosi and Senate Democratic leader Chuck Schumer of seeking unnecessary funding for the Postal Service and trying to pull off a “Universal Mail-In Ballot Scam.”

“Vote NO to the Pelosi/Schumer money wasting HOAX which is taking place now,” the president wrote.

DeJoy told a Senate committee on Friday that the Postal Service would deliver ballots “securely and on time” in the November election but said bigger changes could come after that.

In fact, the House bill would prevent DeJoy from taking any action that would impede service until after next January or the end of the coronavirus health emergency, whichever comes later.

“Our legislation is not just about the election. It’s about – surprise, surprise, Mr. Postmaster General – the coronavirus!” Pelosi told a news conference.

Pelosi insisted that congressional action is necessary, calling DeJoy’s assurances ambiguous and unsatisfactory. “His comments are one thing. His actions will be another. And that’s why we have this legislation,” she said.

She said Trump’s attacks on mail-in voting were part of a larger effort to suppress voting that also includes his recent call for law enforcement officers to monitor voting at polling places.

U.S. postmaster promises timely election mail, ‘dramatic’ changes after

WASHINGTON (Reuters) – U.S. Postmaster Louis DeJoy on Friday told lawmakers the Postal Service would deliver ballots “securely and on time” in the November presidential election, but indicated he would pursue dramatic operational changes after that date.

DeJoy faced pointed questions at a Senate hearing from Democrats, who have accused the wealthy Republican donor of trying to tilt the election to President Donald Trump.

Republicans largely defended DeJoy, saying the Postal Service needed an overhaul. “I am sorry you are on the targeting end of this political hit piece,” Senate Homeland Security Committee Chairman Ron Johnson told him.

DeJoy sought to assure Americans that widespread delays caused by cost-cutting measures would not cause their mail ballots to go uncounted in November. DeJoy suspended those service changes this week after facing public outrage.

“The American people should feel comfortable that the Postal Service will deliver on this election,” he told the Senate Homeland Security Committee.

But DeJoy insisted that overtime limits and other cost-cutting measures would be needed to shore up the finances of a service that lost $9 billion last year. More sweeping changes could be in store after November, he said.

DeJoy, who has donated $2.7 million to Trump and other Republicans since 2016, rejected charges that he was trying to undermine confidence in the Postal Service ahead of an election in which up to half of U.S. voters could vote by mail partly due to the coronavirus pandemic.

Trump has repeatedly and without evidence said that an increase in mail-in ballots would lead to a surge in fraud, although he himself has voted by mail. Trump said last week that he opposes additional Postal Service funding because it could lead to wider use of mail voting.

Experts say it is secure as any other method.

DeJoy said he has not spoken with the Trump campaign or White House Staff Mark Meadows about postal service operations.

He said postal workers will deliver 95 percent of election mail within three days, as they did in the 2018 congressional elections. The increased mail volume would not be a problem for the Postal Service, which sees far larger increases ahead of Christmas and Mother’s Day, he said.

He added that he would personally vote by mail.

DeJoy, however, said he would not bring back mail-sorting machines and mailboxes that have been pulled from service in recent weeks, saying they were routine responses to changes in mail volume, which has dropped in the pandemic. He said he had not ordered those changes.

After he took the job in June, DeJoy imposed reductions in overtime, cuts in retail hours and restrictions on extra mail transportation trips that resulted in widespread delays nationwide.

Bigger changes could be in store after the election. DeJoy urged regulators to allow the Postal Service to raise prices and pressed lawmakers to lower retirement costs. He said the coronavirus pandemic had cost the service $10 billion.

The Washington Post reported on Friday that DeJoy has proposed setting higher prices for service in some states and requiring election ballots to use First Class postage instead of cheaper bulk-mail service, among other changes.

“We’re considering dramatic changes to improve service,” he said.

Republican Senator Rand Paul said he should consider laying off some of the service’s 630,000 employees.

Senator Gary Peters, the top Democrat on the Senate Homeland Security Committee, said he had received more than 7,500 reports of mail delays from people in his home state of Michigan.

“If you plan to continue pursuing these kinds of changes, I think my colleagues, and many of our constituents, will continue to question whether you are the right person to lead this indispensable public institution,” Peters said.

Delaware Senator Tom Carper was caught uttering a series of expletives as he struggled with technology issues in the hearing, which was conducted via video.

Six states and the District of Columbia sued DeJoy on Friday, saying the service changes have harmed their ability to conduct free and fair elections.

Dozens of Democrats in the House of Representatives have called for DeJoy to be fired. DeJoy is due to testify there on Monday.

The House is due to vote Saturday on legislation that would provide $25 billion in Postal Service and require DeJoy to reverse his service changes.

Ballot drop boxes are latest battleground in U.S. election fight

(Reuters) – Welcome to the latest partisan flash point in the U.S. presidential election: the ballot drop box.

As U.S. election officials gird for a dramatic expansion of mail voting in the Nov. 3 election, Democrats across the country are promoting drop boxes as a convenient and reliable option for voters who don’t want to entrust their ballots to the U.S. Postal Service.

President Donald Trump’s re-election campaign, meanwhile, has sued to prevent their use in Pennsylvania, a key battleground state, alleging that the receptacles could enable voting fraud.

Republican officials in other states have prevented their use. Tennessee Secretary of State Tre Hargett told a U.S. Senate committee in July that drop boxes could enable people to violate a state law against collecting ballots.

In Missouri, Republican Secretary of State Jay Ashcroft decided not to distribute 80 drop boxes he had purchased because state law requires those ballots to be returned by mail.

“We didn’t want to cause confusion with voters,” spokeswoman Maura Browning said.

Drop boxes have taken on new urgency after cost-cutting measures at the U.S. Postal Service slowed mail delivery nationwide and Trump has repeatedly attacked the legitimacy of mail ballots. Polls show the Republican president trailing Democratic challenger Joe Biden in a race that some experts say could see half of all votes cast absentee.

Some say the drop box battle is a lot of fuss over a piece of civic furniture — typically a heavily constructed metal box placed in a public location, often monitored by video.

In Connecticut, Secretary of State Denise Merrill is recommending that voters return their ballots via drop box rather than through the mail for the November election, after receiving reports that some ballots mailed a week before the state’s Aug. 11 nominating contests arrived too late to be counted.

Three-quarters of ballots in that August primary were cast absentee, she said, up from roughly 4% in prior years. Merrill, a Democrat, said the state’s 200 newly installed drop boxes had proven a safe and popular option.

“I do not understand why people think they’re such a problem,” Merrill said. “They’re more secure than mailboxes.”

Republicans in Pennsylvania don’t share that sentiment. Trump won that competitive state by less than 1 percentage point in 2016. Winning there again could prove pivotal in his quest to secure a second term in office.

The Trump campaign is suing to force the state to pull all drop boxes used in the June primary. It argues that people could drop off multiple ballots in boxes that are unstaffed, which is an illegal practice in Pennsylvania. State officials “have exponentially enhanced the threat that fraudulent or otherwise ineligible ballots will be cast and counted,” the lawsuit states.

The Trump campaign said in a court filing on Saturday that it had complied with a judge’s order to provide evidence of alleged fraud to the defendants. That evidence has not been made public. Trump lawyers did not respond to a request by Reuters to see it.

Bruce Marks, a former Republican state senator in Pennsylvania, said drop boxes do not provide a clear chain of custody for the ballots deposited inside.

“There’s no one watching or tracking,” he said.

Proponents say stuffing a ballot into a locked drop box is no different from dropping one into a Postal Service letter box. Pennsylvania Republicans oppose drop boxes because Democrats have had much more success in getting their voters to sign up for mail ballots this year, greater than a two-to-on margin, said Brendan Welch, a spokesman for the Pennsylvania Democratic Party.

“(Republicans) know the easier it is for everyday people to vote, the more likely it is that they will lose,” Welch said. “Maybe they should spend their energy trying to match Pennsylvania Democrats’ organizing efforts in the Keystone State instead.”

Democratic Governor Tom Wolf has defended Pennsylvania’s use of drop boxes, arguing they are legal and essential, particularly in the age of the coronavirus.

ONE BOX, 864,000 VOTERS

In neighboring Ohio, Republican Secretary of State Frank LaRose said last week that he did not want to risk a similar lawsuit as he announced that he would authorize one drop box for each of the state’s 88 counties. He said the Republican-controlled legislature had not given him the authority to provide more.

Democrats are pressing LaRose to revise his decision, pointing out that it leaves the 864,000 registered voters of Cleveland’s Cuyahoga County, a Democratic stronghold, with the same number of drop boxes as the 8,400 registered voters of Republican Vinton County.

“You can’t have a one-size-fits-all approach with our counties,” said Kathleen Clyde, a senior adviser for the Biden campaign in Ohio. “One drop box doesn’t cut it.”

LaRose in the meantime is trying to secure prepaid postage for mail ballots, spokeswoman Maggie Sheehan said, “effectively making every mailbox its own drop box.”

Michigan, another battleground state, has added drop boxes this year.

Wisconsin’s five largest cities, including Milwaukee, are setting up drop boxes as part of a secure-voting plan funded by the Center for Tech and Civic Life, a nonprofit group.

In hotly contested Florida, Democrats in Miami-Dade County, the state’s largest, are seeking to remove some procedural hurdles to make it easier for voters to use drop boxes.

Unlike other counties in the state, Miami-Dade voters must provide election officials with valid identification when dropping off a ballot at a drop box. Election workers also manually record a 14-digit number printed on the voter’s envelope into a log.

The whole process can take up to three minutes, the Democratic Party said in a letter to local election officials seeking to allow voters to drop their ballots quickly without the processing requirements.

“Trump has sabotaged the post office deliberately and we have to find ways around that. We think making it easier to use a drop box, and avoid the post office, is part of the solution,” said Steve Simeonidis, chairman of the Miami-Dade Democratic Party.

The White House has said Trump never told the Postal Service to change its operations.

NOT TENSE EVERYWHERE

Security measures required for ballot drop boxes vary by state. In Montana, these receptacles must be staffed by at least two election officials, while in New Mexico they must be monitored by video, according to the National Conference of State Legislatures.

Before 2020, eight states — Arizona, California, Colorado, Hawaii, Montana, New Mexico, Oregon and Washington — had laws detailing how and where drop boxes could be used.

Returning ballots this way proved popular: In Colorado, Oregon and Washington, more than half of mail ballots were returned either to a drop box or to an election office in the 2016 presidential election, according to a Massachusetts Institute of Technology survey.

Drop boxes haven’t been controversial in those states.

“Both parties use it at a really high rate, so a lot of those tensions don’t exist here,” said Murphy Bannerman of Election Protection Arizona, a nonpartisan voting-rights group.

U.S. House to vote on $25 billion postal infusion, mail-in ballot safeguards

WASHINGTON (Reuters) – U.S. House of Representatives Democrats unveiled on Wednesday legislation that would require same-day processing for mail-in ballots and give the cash-strapped Postal Service a $25 billion infusion while erasing changes pursued by the agency’s new leader, an ally of President Donald Trump.

The Democratic-led House is scheduled to vote on the legislation on Saturday, though there is little chance for passage in the Republican-led Senate. The bill would prevent the Postal Service from implementing policies to alter service levels that were in effect at the beginning of this year.

Democrats and other critics have accused the Republican president of trying to impair the Postal Service to suppress mail-in voting as he trails Democratic challenger Joe Biden in opinion polls ahead of the Nov. 3 election.

Under intense criticism, Postmaster General Louis DeJoy announced on Tuesday that he would put on hold until after the election cost-cutting moves at the Postal Service that Democratic lawmakers and state attorneys general argued could imperil mail-in voting. DeJoy said he suspended all “operational initiatives” through Election Day to “avoid even the appearance of any impact on election mail.”

DeJoy, who has been a major political donor to Trump, assumed the job in June.

The Postal Service long has faced financial woes with the rise of email and social media, losing $80 billion since 2007, including $2.2 billion in the three months ending June 30.

Democrats want DeJoy to explain how he will reverse the changes he has made, including whether he will order the return of sorting machines already removed.

Separately, Senator Chuck Schumer, the top Senate Democrat, asked the Postal Service Board of Governors to release all materials related to the selection of DeJoy and for “additional information” regarding the role of Trump and Treasury Secretary Mnuchin in the search and selection process.

The board in May said it reviewed records of more than 200 candidates before narrowing the list to more than 50. The board then interviewed more than a dozen candidates in first round interviews, and invited seven candidates for follow-up interviews.

Trump has repeatedly and without evidence claimed that mail balloting is vulnerable to fraud. Voting by mail is nothing new in the United States, and Trump himself plans to vote by mail in Florida this year.

White House Chief of Staff Mark Meadows said the White House was not involved in the Postal Service changes. The Treasury Department and the Postal Service did not immediately respond to requests for comment.

Trump says he is holding up coronavirus aid to block Democrats’ bid for election funding

WASHINGTON (Reuters) – Funding for the U.S. Postal Service and to shore up election infrastructure is the main sticking point in talks between the White House and top congressional Democrats over a fresh round of coronavirus relief, President Donald Trump said on Thursday.

Trump said his negotiators have resisted Democrats’ calls for additional money to help U.S. election officials prepare for a presidential contest during a pandemic that has killed more than 165,000 Americans and presented severe logistical challenges to organizing large events like the Nov. 3 election.

“The items are the post office and the $3.5 billion for mail-in voting,” Trump told Fox Business Network, saying Democrats want to give the post office $25 billion. “If we don’t make the deal, that means they can’t have the money, that means they can’t have universal mail-in voting. It just can’t happen.”

Trump has repeatedly claimed without evidence that mail-in voting, a way to allow citizens to take part in the election without creating crowding that raises the risk of transmitting COVID-19, is likely to be rife with fraud. Experts who study elections say there is little proof that this is the case.

The White House negotiating team of Treasury Secretary Steve Mnuchin and Chief of Staff Mark Meadows has not met with House of Representatives Speaker Nancy Pelosi and Senate Minority Leader Chuck Schumer in six days.

When the two sides last met Friday, they were some $2 trillion apart in their negotiating positions. A Reuters/Ipsos poll this week showed that Americans blame both parties for the standoff, which has led to the expiration of a $600 per week lifeline to unemployed people.

New Postmaster General Louis DeJoy, who has donated $2.7 million to Trump and his fellow Republicans since 2017, has ordered operational changes and a clampdown on overtime in a bid to fix the financially troubled Postal Service, which reported a net loss of $2.2 billion in the last quarter.

U.S. House panel to hold Postal Service hearing amid 2020 election concerns

WASHINGTON (Reuters) – A U.S. House of Representatives committee plans to hold a Sept. 17 hearing with new Postmaster General Louis DeJoy to examine operational changes to the U.S. Postal Service amid concerns about the 2020 election and recent reports of a slowdown in some deliveries.

The House Committee on Oversight and Reform invited DeJoy “to examine recent changes to U.S. Postal Service operations and standards and the need for on-time mail delivery during the ongoing pandemic and upcoming election, which as you know may be held largely by mail-in ballot,” said Representative Carolyn Maloney, who chairs the panel.

Maloney and other senior House Democrats warned in a July 20 letter that “increases in mail delivery timing would impair the ability of ballots to be received and counted in a timely manner — an unacceptable outcome for a free and fair election.”

A spokesman for DeJoy declined to comment on the hearing.

The Postal Service will report third-quarter financials on Friday when the board holds a virtual meeting.

A group of senators last week raised concerns that delaying mail deliveries could hinder attempts to mail in ballots for the 2020 election by Americans fearful about voting in person during a pandemic.

U.S. President Donald Trump threatened to sue Nevada after Democratic lawmakers passed a bill on Sunday that would send mail-in ballots to every voter ahead of November’s presidential election in light of the coronavirus pandemic.

Trump, who has claimed without evidence that voting by mail will lead to rampant fraud, wrote on Twitter on Monday that the legislation approved on Sunday was an “illegal late night coup.”

If the state’s Democratic governor, Steve Sisolak, signs the bill as expected, Nevada would become the seventh state to send ballots to all registered voters for the Nov. 3 election.

Explainer: Fraud is rare in U.S. mail-in voting. Here are the methods that prevent it

WASHINGTON (Reuters) – With the number of Americans voting by mail on Nov. 3 expected to nearly double due to COVID-19, election experts see little reason to expect an increase in ballot fraud, despite President Donald Trump’s repeated claims.

Voting by mail is not new in the United States — nearly 1 in 4 voters cast 2016 presidential ballots that way. Routine methods and the decentralized nature of U.S. elections make it very hard to interfere with mailed ballots, experts say.

While mail balloting has its drawbacks, it can help minimize the long lines, faulty voting machines and COVID-19-induced staffing shortages that have plagued some elections this year.

HOW SECURE IS IT?

Election experts say it would be nearly impossible for foreign actors to disrupt an election by mailing out fake ballots, a scenario floated by Attorney General William Barr.

For one thing, voters won’t just be selecting a president: They might be choosing candidates for city council, school board and weighing in on ballot initiatives. That can require hundreds of different ballot designs in a single county and the United States has more than 3,000 counties.

Ballots aren’t counted if they aren’t printed on the proper type of paper and don’t include specific technical markings.

States also require voters to sign the outside of their envelope, which they match to a signature on file.

Some 29 states and the District of Columbia allow voters to track their ballots to ensure they are received, according to the National Conference of State Legislatures. Fourteen states and D.C. also allow voters to return their ballots by hand if they don’t trust the mail.

Those envelopes are typically opened by a different group of workers than those who scan the ballots. Outside observers are allowed to monitor the process to ensure voter privacy.

IS FRAUD A PROBLEM?

As with other forms of voting, documented cases of mail-ballot fraud are extremely rare.

The conservative Heritage Foundation, which has warned of the risks of mail voting, found 14 cases of attempted mail fraud out of roughly 15.5 million ballots cast in Oregon since that state started conducting elections by mail in 1998.

The most prominent cases of mail fraud have involved campaigns, not voters. North Carolina invalidated the results of a 2018 congressional election after state officials found that a Republican campaign operative had orchestrated a ballot fraud scheme.

Experts say those scenarios can be minimized by nixing requirements — currently in place in 11 states — which instruct voters to get at least one witness to sign their return envelopes.

“All of these policies remove the need to hand over your ballot to someone you don’t know,” said Tammy Patrick, a former election official in Maricopa County, Arizona.

DOES IT HELP TURNOUT?

Turnout rates tend to be higher in states that conduct elections by mail. A Stanford University study found that participation increased by roughly 2 percentage points in three states that rolled out universal voting by mail from 1996 to 2018. It had no effect on partisan outcome and did not appear to give an advantage to any particular racial, economic or age group.

In Colorado, 77% of voting age citizens cast ballots in the 2016 presidential election, the highest figure in the country, according to the U.S. Election Assistance Commission. In Oregon, that figure was 72% and in Washington it was 68%, well above the national rate of 63%.

ARE THERE BARRIERS?

Like any other voting method, mail balloting has its drawbacks.

States rejected 1% of returned ballots in 2016 for arriving too late, missing signatures or other problems, according to EAC figures — though that figure was as high as 5% in some states. It can be more difficult to fix errors on mail ballots than on those cast in person, experts say.

Mail ballots can pose additional barriers to those who don’t speak English or have disabilities, and delivery can be problematic on Native American reservations, where residents sometimes don’t have street addresses.

In California, which started transitioning to mail ballots in 2018, Black and Hispanic voters were twice as likely to cast their ballots in person, according to David Becker, head of the Center for Election Innovation and Research.

U.S. Supreme Court restricts ‘electors’ in presidential contests

WASHINGTON (Reuters) – The U.S. Supreme Court on Monday refused to free “electors” in the complex Electoral College system that decides the U.S. presidency from state laws that use penalties to force them to support the candidate who prevails in the state’s popular vote.

The justices unanimously declined to endorse the discretionary power of electors just months before the Nov. 3 presidential election. The justices ruled in favor of Washington state and Colorado, which had imposed penalties on several so-called faithless electors who defied pledges in 2016 to vote for the winner of their states’ popular vote, Democrat Hillary Clinton.

State officials have said faithless electors threaten the integrity of American democracy by subverting the will of the electorate and opening the door to corruption. The plaintiffs said the Constitution requires them to exercise independent judgment to prevent unfit candidates from taking office.

“The Constitution’s text and the nation’s history both support allowing a state to enforce an elector’s pledge to support his party’s nominee – and the state voters’ choice – for President,” Justice Elena Kagan wrote on behalf of the court.

Under the system set out in the U.S. Constitution in the 18th century, the winner of a presidential election is determined not by amassing a majority in the national popular vote but by securing a majority of electoral votes allotted to the 50 U.S. states and the District of Columbia.

In 2016, 10 of the 538 electors cast ballots for someone other then their state’s popular vote winner, an unusually high number that could have changed the outcome of five of the 58 previous U.S. presidential elections.

The justices on Monday upheld a decision by the Washington state Supreme Court that had found the $1,000 fines against three faithless electors to be lawful and did not violate the Constitution’s provisions that spell out the Electoral College process.

The justices also reversed a 2019 ruling by the Denver-based 10th U.S. Circuit Court of Appeals against Colorado’s cancellation of a faithless elector’s vote. Justice Sonia Sotomayor did not participate in the Colorado case.

Republican President Donald Trump, who defeated Clinton by a margin of 304 to 227 Electoral College votes despite losing the popular vote nationally by about 3 million votes, is seeking re-election against Democratic candidate Joe Biden.

In the Electoral College vote held weeks after the general election, the electors – typically party loyalists – cast their ballots to formally determine the election’s winner. Colorado and Washington state are among the 48 states – only Maine and Nebraska excepted – with winner-takes-all systems awarding all electors to the candidate who wins the state’s popular vote.

Thirty-two states and the District of Columbia have laws intended to control how electors vote. Only a handful enforce them with penalties.

The two lead plaintiffs in the cases decided on Monday, Bret Chiafalo and Micheal Baca, were Democratic electors who sought to persuade Republican electors to disregard their pledges and help deny Trump the presidency. They cast their ballots for moderate Republicans and not Clinton even though she won the popular vote in both states.
