WASHINGTON (Reuters) – U.S. senators, who had expected just weeks ago to be turning their attention to an impeachment trial of President Donald Trump, will kick off the week focusing on “ordinary business,” with lawmakers still at loggerheads over trial rules.

Democrats have been pressing for witnesses to be called, but Trump’s fellow Republicans have held firm that any decision on testimony must wait until after opening statements are heard.

Complicating the calculus, House of Representatives Speaker Nancy Pelosi – the top Democrat in Congress – has yet to send the House-approved impeachment articles to the Senate, putting a question mark over the schedule for a trial and buying time for Democrats to try to build the case for witnesses.

Senate Republican leader Mitch McConnell, who Pelosi accuses of carrying water for the president, has said a trial cannot begin until the charges are formally sent to the chamber, although another senior Republican called on Sunday for the rules to be changed if Pelosi does not act soon.

“We’re not going to let Nancy Pelosi use the rules of the Senate to her advantage,” Senate Judiciary Committee Chairman Lindsey Graham, a Trump ally, told Fox News Channel’s “Sunday Morning Futures.”

Without the articles in hand, McConnell said on Friday that senators would focus on “ordinary business” – in Monday’s case, a nomination for a new head of the Small Business Administration.

The earliest the House could take any action would be Tuesday when it reconvenes, but top Democrats have given no sign they are set to move this week.

“I don’t think it’s going to be indefinite,” House Intelligence Committee Chairman Adam Schiff, a Democrat, told CNN’s “State of the Union” on Sunday when asked about the delay in transmitting the impeachment articles.

“I don’t think that’s at all the desire, motivation here. The desire is to get a commitment from the Senate that they’re going to have a fair trial.”

The Democratic-led House has charged Trump with abusing his power for personal gain by asking Ukraine to announce a corruption investigation of former Vice President Joe Biden, a leading contender for the Democratic nomination to face Trump in November’s presidential election.

It also charged the president with obstructing Congress by directing administration officials and agencies not to cooperate with the impeachment inquiry.

Trump says he did nothing wrong and has dismissed his impeachment as a partisan bid to undo his 2016 election win.

The Senate, which is controlled by Republicans 53-47, is unlikely to vote to find the president guilty and remove him from office, an act that would take a two-thirds majority.

But Democrats have been hopeful they could persuade a few Republicans to side with them on their push for witnesses, which would require only a simple majority and could unearth evidence damaging to Trump.

WASHINGTON (Reuters) – Senate Majority Leader Mitch McConnell said on Monday that Republicans had not ruled out hearing witnesses in the impeachment trial of President Donald Trump, one of the main sticking points in drafting rules for the proceedings.

However, McConnell made clear he would not accede to a Democratic request for the U.S. Senate to agree ahead of time to take testimony during the trial.

The Republican leader instead repeated his position in an interview with Fox News Channel that any decision on witnesses be made after opening arguments in the case from both Democrats and representatives for Trump.

Allowing witness testimony, particularly from current and former administration officials, was likely to prolong the trial and could bring up new evidence damaging to Trump.

Republicans have a 53-seat majority in the Senate, where 51 votes are needed to pass a set of rules for the Trump trial.

The Republican president was impeached last week by the Democratic-led House of Representatives on two charges over his pressuring Ukraine to announce an investigation of former vice president Joe Biden and Biden’s son. Biden is a potential Democratic candidate to run against Republican Trump in the November 2020 election. Hunter Biden was on the board of a Ukrainian energy company.

Trump was charged with abuse of power and obstructing Congress’ investigation. He has said he did nothing wrong.

There is little chance Trump will be convicted and removed from office through a trial in the Republican-led Senate, but the impeachment proceedings could resonate at the ballot box in November.

Senate Democratic leader Chuck Schumer has requested to have four witnesses subpoenaed for the Senate trial expected to begin early next year. The White House blocked all four, including acting Chief of Staff Mick Mulvaney and former national security adviser John Bolton, from testifying during impeachment proceedings in the House of Representatives in December.

“We haven’t ruled out witnesses,” McConnell said in an interview with “Fox & Friends.” “We’ve said, ‘Let’s handle this case just like we did with President Clinton.’ Fair is fair.”

In that 1999 trial, he said, senators went through opening arguments, had a written question period and then decided what witnesses to call based on that.

McConnell and Schumer failed to reach an agreement on Thursday on rules for the trial, which McConnell said would be the Senate’s first order of business in the new year.

“We remain at an impasse on these logistics,” McConnell said on Thursday.

He used the word “impasse” again on Monday in saying senators could not take any action until House Speaker Nancy Pelosi formally transmits the articles of impeachment to the Senate. Pelosi has withheld them in a bid to pressure Senate Republicans to reach an accord with Schumer on trial rules.

Schumer and other Democrats have criticized McConnell for working closely with the White House on trial strategy, saying he was not acting like an impartial juror.

Senators are expected to be administered an oath promising to do “impartial justice according to the Constitution” at the start of any impeachment trial.

McConnell dismissed the criticism in the Fox interview, asking if any Democratic leaders were impartial.

“Let’s quit the charade,” McConnell said. “This is a political exercise. A political exercise.”

WASHINGTON (Reuters) – President Donald Trump will address the two impeachment charges brought by Democrats on Tuesday during the U.S. Senate trial phase of the proceedings – continuing to opt not to argue the merits of the charges ahead of an expected vote in the U.S. House, the White House said.

“The President will address these false charges in the Senate and expects to be fully exonerated, because he did nothing wrong,” White House Press Secretary Stephanie Grisham said in a statement. The statement did not make clear how he would address the charges.

The White House and Trump’s political apparatus – which include his re-election campaign and the Republican National Committee – have opted to attack the impeachment process instead of engaging in a debate about the facts that Democrats have presented.

Calling the process partisan and lacking in fairness, Trump and his allies have sought to paint his Democratic accusers as trying to undo his 2016 election.

Democrats in the U.S. House of Representatives announced formal charges against Trump on Tuesday, accusing him of abusing power by pressuring Ukraine to probe a political rival and obstructing Congress’ investigation into the scandal.

The House could vote as soon as next week. The charges conclude weeks of investigation and hearings, which Trump has derided as one-sided and failing to offer him a fair opportunity to present his side. The White House has refused repeated requests for senior officials to testify and for relevant documents.

The House is almost certain to approve impeachment along partisan lines. A trial would then likely be held in the Senate in January, where members of Trump’s party control the chamber. No Republican in the House or Senate has come out in favor of convicting Trump and thus removing him from office.

Trump and his allies have sought to depict the impeachment process as a net gain for the president – arguing that the Democratic-led effort has pushed his supporters to more staunchly back him. Republicans are also trying to leverage the process to attack House Democrats who represent districts the party may be able to pick up in the 2020 election.

“The announcement of two baseless articles of impeachment does not hurt the President, it hurts the American people, who expect their elected officials to work on their behalf to strengthen our Nation,” Grisham said in a statement.

Explainer: How impeachment works and why Trump is unlikely to be removed

WASHINGTON (Reuters) – U.S. House of Representatives Speaker Nancy Pelosi on Thursday instructed the House Judiciary Committee to draft articles of impeachment against President Donald Trump for pressuring Ukraine to investigate a political rival.

What happens next and why Trump is unlikely to be removed from office are both explained here.

WHY IMPEACHMENT?

The founders of the United States feared presidents abusing their powers, so they included in the Constitution a process for removing one from office.

The president, under the Constitution, can be removed from office for “Treason, Bribery, or other high Crimes and Misdemeanors.”

High crimes and misdemeanors have historically encompassed corruption and abuses of the public trust, as opposed to indictable violations of criminal statutes.

Former President Gerald Ford, while in Congress, famously said: “An impeachable offense is whatever a majority of the House of Representatives considers it to be at a given moment in history.”

No president has ever been removed as a direct result of impeachment. One, Richard Nixon, resigned before he could be removed. Two, Andrew Johnson and Bill Clinton, were impeached by the House but not convicted by the Senate.

HOW DOES IT WORK?

Impeachment begins in the House, the lower chamber, which debates and votes on whether to bring charges against the president via approval of an impeachment resolution, or “articles of impeachment,” by a simple majority of the body’s members.

The Constitution gives House leaders wide latitude in deciding how to conduct impeachment proceedings, legal experts said.

The House Intelligence Committee has conducted an investigation into whether Trump abused his power to pressure Ukraine to launch investigations that would benefit him politically, holding weeks of closed-door testimony and televised hearings before issuing a formal evidence report.

The Judiciary panel will use the report to consider formal charges that could form the basis of a full House impeachment vote by the end of December.

If the House approves articles of impeachment, a trial is then held in the Senate. House members act as the prosecutors; the senators as jurors; the chief justice of the United States presides. Historically, the president has been allowed to have defense lawyers call witnesses and request documents.

CAN THE SENATE REFUSE TO HOLD A TRIAL?

There is debate about whether the Constitution requires a Senate trial. But Senate rules in effect require a trial, and Senate Majority Leader Mitch McConnell has publicly stated that he will allow one to proceed.

Republicans could seek to amend those rules, but such a move is politically risky and considered unlikely, legal experts said.

WHAT ABOUT OPENING A TRIAL AND QUICKLY ENDING IT?

The Senate rules allow members to file, before the conclusion of the trial, motions to dismiss the charges against the president. If such a motion passes by a simple majority the impeachment proceedings effectively end.

Clinton’s Senate impeachment trial, which did not end in a conviction, lasted five weeks. Halfway through the proceedings, a Democratic senator introduced a motion to dismiss, which was voted down.

WHAT’S THE PARTY BREAKDOWN IN CONGRESS?

Democrats control the House. The House comprises 431 members at present, 233 of whom are Democrats. As a result, the Democrats could impeach the Republican Trump with no Republican support.

In 1998, when Republicans had a House majority, the chamber voted largely along party lines to impeach Clinton, a Democrat.

The Senate now has 53 Republicans, 45 Democrats and two independents who usually vote with the Democrats. Conviction and removal of a president would require a two-thirds majority. A conviction seems unlikely. Should all 100 senators vote, at least 20 Republicans and all the Democrats and independents would have to vote against him.

WHO BECOMES PRESIDENT IF TRUMP IS REMOVED?

In the unlikely event the Senate convicted Trump, Vice President Mike Pence would become president for the remainder of Trump’s term, which ends on Jan. 20, 2021.

U.S. Senate passes HK rights bill backing protesters, angers Beijing

WASHINGTON (Reuters) – The U.S. Senate unanimously passed legislation on Tuesday aimed at protecting human rights in Hong Kong amid a crackdown on a pro-democracy protest movement, drawing condemnation from Beijing.

Following the voice vote, the “Hong Kong Human Rights and Democracy Act” will go to the House of Representatives, which approved its own version last month. The two chambers will have to work out their differences before any legislation can be sent to President Donald Trump for his consideration.

“The people of Hong Kong see what’s coming – they see the steady effort to erode the autonomy and their freedoms,” Republican Senator Marco Rubio said at the start of the brief Senate debate, accusing Beijing of being behind the “violence and repression” in the Asian financial hub.

The Senate passed a second bill, also unanimously, that would ban the export of certain crowd-control munitions to Hong Kong police forces. It bans the export of items such as tear gas, pepper spray, rubber bullets and stun guns.

Under the first Senate bill, U.S. Secretary of State Mike Pompeo would have to certify at least once a year that Hong Kong retains enough autonomy to qualify for special U.S. trading consideration that bolsters its status as a world financial center. It also would provide for sanctions against officials responsible for human rights violations in Hong Kong.

There was no immediate response from the White House, which has yet to say whether Trump would approve the Hong Kong Human Rights bill. A U.S. official said recently that no decision had been made, but the unanimous Senate vote could make a veto more difficult for the Republican president.

The official, who spoke on condition of anonymity, said if the measure got to Trump’s desk there would probably be an intense debate between Trump aides worried it could undermine trade talks with China and those who believe it is time to take a stand against China on human rights and Hong Kong’s status.

In Beijing on Wednesday, China condemned the passage of the Hong Kong Human Rights and Democracy Act, and vowed strong counter-measures to safeguard its sovereignty and security.

“This act neglects facts and truth, applies double standards and blatantly interferes in Hong Kong affairs and China’s other internal affairs,” foreign ministry spokesman Geng Shuang said in a statement.

“It is in serious violation of international law and basic norms governing international relations. China condemns and firmly opposes it.”

The United States must immediately stop interfering in Hong Kong affairs and China’s other internal affairs, or “the negative consequences will boomerang on itself”, Geng added.

Pompeo said on Monday the United States was gravely concerned about Hong Kong’s deepening unrest and violence, urging the city’s government to tackle public concerns and China to honor the promises it made to maintain liberties after taking back the territory from British rule in 1997.

Pompeo addressed the issue again on Tuesday before leaving the United States for a NATO meeting in Brussels.

“We continue to urge everyone to do this peacefully,” he told reporters. “There is a political resolution of this that is achievable, we hope that’ll be the path forward.”

Demonstrators are angry at what they see as Chinese meddling in the freedoms promised to Hong Kong when Britain handed it back to China.

Senate aides said they expected the legislation eventually would move forward as an amendment to a massive defense bill, the National Defense Authorization Act, expected to pass Congress later this year.

Demonstrators in Hong Kong have been protesting in the streets amid increasing violence and fears that Beijing will ratchet up its response to stop the civil disobedience.

Following passage of the bill, Senate Democratic Leader Chuck Schumer said, “We have sent a message to President Xi (Jinping): Your suppression of freedom, whether in Hong Kong, in northwest China or in anywhere else, will not stand.

“You cannot be a great leader – and you cannot be a great country – when you oppose freedom, when you are so brutal to the people of Hong Kong, young and old, who are protesting.”

Xinjiang, in northwest China, is home to many mostly Muslim Uighurs, large numbers of whom have been detained in what China says are vocational training centers, but which some U.S. officials have called “concentration camps.”

This month the foreign ministry said China had lodged “stern representations” with the United States about the legislation and urged that it not be passed into law.

China would “inevitably take vigorous measures to firmly respond, to staunchly safeguard our sovereignty, security and development interests,” the ministry added.

Trump prompted questions about his commitment to protecting freedoms in Hong Kong when he referred in August to the mass street protests as “riots” that were a matter for China to deal with.

Trump has since urged China to handle the issue humanely, warning that anything bad that happened in Hong Kong could hurt talks to end a trade war between the world’s two largest economies.

In a post on Twitter on Wednesday, China’s embassy in the United States said, “The democracy and human rights held so dearly by the American people are once again abused by some American politicians to justify violence and disorder.”

It added, “Do they want to side with the rioters? SAD!”

(Reuters) – The U.S. House and Senate will try to resolve their conflicting versions of an emergency funding bill on Thursday to address worsening humanitarian conditions for migrant children and families on the U.S.-Mexico border.

The Republican-controlled Senate passed by an overwhelming 84-8 vote a $4.6 billion spending bill on Wednesday. The Democratic-led House of Representatives on Tuesday night tied more strings to its approval of the money, setting standards for health and nutrition of migrants in custody after reports they lacked necessities such as soap and diapers.

A photo of drowned migrants, and reports of horrendous conditions for detained children have spurred efforts to craft compromise legislation to send to U.S. President Donald Trump before Congress breaks this week for the U.S. Independence Day holiday.

Whether Trump will sign a deal is uncertain as he continues to push for spending on the kind of border security some Democratic adversaries blame for migrant deaths.

Trump has made cracking down on immigration a centerpiece of his administration but officials are saying they will soon run out of money for border agencies. Border crossings hit their highest level in more than a decade in May, straining resources and creating chaotic scenes at overcrowded border patrol facilities.

The need for funding has become more urgent as attorneys last week called attention to more than 300 children detained in squalid conditions at a border patrol facility in Clint, Texas.

Reporters given a short tour of the facility on Wednesday were told by Station Chief Matthew Harris that it currently has 117 children in custody, but that a month and a half ago the number peaked at almost 700 children.

Harris said the facility was designed to hold people in custody for eight to ten hours. He said the average stay now was six to ten days, with teenage mothers staying up to two weeks, and some medical cases more than a month in the hospital.

Some older teenage girls could be seen talking and laughing, while others wore distraught looks. Some teenage boys played soccer while small children sat on the floor with blankets.

Trump has made building a wall along the southern border a key goal of his administration, but government officials say they need money to keep migrant housing facilities open past month end.

Border crossings hit their highest monthly level since 2006 in May, with more than 60% of migrants either children or families, mostly from Central America.

Lawyers and human rights workers said they found sick and hungry children when they visited the border patrol facility in Clint, Texas earlier this month.

“Many had been detained for weeks, one even up to a month in really horrific conditions,” said Clara Long, senior researcher at Human Rights Watch.

The conditions of unaccompanied children crossing the border has become a key issue in the 2020 presidential race. During a debate on Wednesday night, many of the Democratic candidates called for an overhaul of U.S. immigration laws and about 12 of them are set to visit a Florida facility this week.

A photo of a Salvadoran father and his toddler daughter who drowned attempting to cross the Rio Grande added urgency on both sides of the aisle to reach a funding deal.

Trump criticized the House bill on Wednesday, telling Fox Business Network he wanted more money for “protection” from the drug traffickers and other criminals he says are taking advantage of the family surge to slip into the country.

WASHINGTON (Reuters) – The U.S. Senate on Wednesday rejected a bill approved a day earlier by the House of Representatives that would have provided $4.5 billion to address a surge in migration at the U.S. border with Mexico, while setting new standards for the care of migrants taken into custody.

Last month, President Donald Trump requested aid for programs to house, feed, transport and oversee a surge of Central American migrants seeking asylum in the United States.

But he had vowed to veto the House legislation. White House officials had said the bill would hamper the Trump administration’s border enforcement efforts.

The Senate was set to move to a separate vote on its own border aid bill after defeating the House measure.

U.S. House fails to pass disaster aid bill; second attempt likely next month

WASHINGTON (Reuters) – The U.S. House of Representatives on Friday failed to pass a $19.1 billion disaster aid bill supported by President Donald Trump, but is expected to try again early next month.

Following Senate passage of the legislation on Thursday by a vote of 85-8, House leaders had hoped to win quick, unanimous approval of the bill and send it to Trump for his expected signature.

But since the House did not go through regular, more time-consuming procedures, it needed the consent of all of its current 432 members to approve the bill.

For months, lawmakers have been haggling behind the scenes over the disaster aid bill in response to hurricanes in the southeastern U.S., severe flooding in the Midwest, devastating wildfires in California and other events.

The $19.1 billion in the bill is intended to help farmers cover their crop losses and rebuild infrastructure hit by disasters, including repairs to U.S. military bases.

Representative Chip Roy, a first-term Republican, objected to holding the vote, citing concerns that the legislation did not include $4.5 billion Trump had requested to deal with a surge of Central American immigrants on the southwestern border.

Roy also complained that the cost of the bill was not offset by savings to other government programs.

“This is a $19-billion bill that is not paid for when we are racking up $100 million of debt per hour,” Roy complained.

Congress regularly approves “emergency” disaster aid bills without any cuts to other programs, despite objections from some conservative lawmakers.

When the House returns from a week-long Memorial Day recess it is expected to bring the legislation back to the House floor for likely passage.

Friday’s action played out in a nearly empty House chamber as most of its members have left Washington for a week-long Memorial Day holiday recess.

WASHINGTON (Reuters) – Retired Army General John Abizaid, U.S. President Donald Trump’s nominee to be ambassador to Saudi Arabia, defended the U.S.-Saudi relationship on Wednesday as lawmakers accused the kingdom of a litany of misdeeds and criticized its crown prince as going “full gangster.”

Senators at Abizaid’s confirmation hearing, Trump’s fellow Republicans as well as Democrats, condemned the kingdom’s conduct in the civil war in Yemen, heavy-handed diplomacy and rights abuses including torturing women’s rights activists and the murder of Saudi journalist Jamal Khashoggi.

Abizaid called for accountability for the murder of Khashoggi, a U.S. resident, and support for human rights, but repeatedly stressed the importance of Washington-Riyadh ties.

Despite increasing tension between the two countries, the United States has not had an ambassador there since Trump became president in January 2017.

“In the long run, we need a strong and mature partnership with Saudi Arabia,” Abizaid told the Senate Foreign Relations Committee. “It is in our interests to make sure that the relationship is sound.”

Abizaid, a retired four-star Army general, led U.S. Central Command during the Iraq war. Expected to easily win Senate confirmation, he was praised by senators from both parties at the hearing.

Khashoggi, a Washington Post columnist and critic of the Riyadh government, was killed at a Saudi consulate in Turkey in October. His death fueled simmering discontent in Washington over Saudi Arabia’s human rights record and heavy civilian casualties in Yemen’s civil war, where a Saudi-led coalition is fighting Iran-backed Houthi rebels.

The House of Representatives has passed a war powers resolution that would end all U.S. support for the Saudi-led coalition, but Abizaid said the Trump administration believes strongly that U.S. support should continue.

“Doing so bolsters the self-defense capabilities of our partners and reduces the risk of harm to civilians,” Abizaid said.

‘FULL GANGSTER’

The measure passed the Senate last year, but must go through the chamber again this year to be sent to the White House, where Trump is expected to issue a veto. However, its support in Congress is considered a strong rebuke of Riyadh.

Lawmakers have been strongly critical of Mohammed bin Salman, the powerful Saudi crown prince. Some blame him for Khashoggi’s killing and other human rights abuses.

Eleven suspects have been indicted in Saudi Arabia for Khashoggi’s murder, and last month a top Saudi official rejected accusations that the crown prince ordered the killing.

Republican Senator Jim Risch, the committee’s chairman, said Washington needed to send a strong message to Saudi Arabia about actions that he said are complicating the relationship.

“It’s going to have to be addressed by the Saudis and by the Crown Prince,” Risch said.

“The Crown Prince has launched Saudi Arabia into a devastating war in Yemen, isolated Qatar, threatening Gulf cooperation and coordination against threats from Iran and regional terrorist groups, detained and tortured members of his own family and effectively hoodwinked and intimidated the Lebanese prime minister,” said Senator Bob Menendez, the committee’s top Democrat.

As Abizaid’s hearing continued, at least two Republicans said bin Salman had gone “full gangster.”

One, Republican Marco Rubio, cited a long list of actions including the imprisonment of women’s rights activists and the 2017 detention of Lebanese Prime Minister Saad al-Hariri.

Abizaid said in prepared remarks that the Islamic State militant group has been “nearly vanquished on the ground,” but remains a “potent threat” to the United States and its allies.

While contradicted by some U.S. military and intelligence officials, Trump has declared that Islamic State has been driven out of all its territory since announcing in December that he would withdraw U.S. forces from Syria. He claimed that U.S.-led forces had succeeded in their mission to defeat the militant group.

Since then, Trump has decided to leave hundreds of U.S. troops in the country over the longer run.

Trump asks U.S. Congress to prohibit late-term abortion

WASHINGTON (Reuters) – U.S. President Donald Trump called for curbs on late-term abortion in his State of the Union address on Tuesday, citing controversies over the issue in New York and Virginia.

Using emotive language, Trump waded into what has long been a divisive issue in American politics, even though the procedure was legalized in a Supreme Court ruling more than 40 years ago.

“To defend the dignity of every person, I am asking the Congress to pass legislation to prohibit the late-term abortion of children who can feel pain in the mother’s womb,” Trump said.

“Let us work together to build a culture that cherishes innocent life. Let us reaffirm a fundamental truth: all children – born and unborn – are made in the holy image of God,” he said.

The issue of whether a fetus feels pain has been raised frequently in recent years by abortion opponents pushing for more restrictions in state legislatures. Medical opinion on the issue is not conclusive.

With the confirmation last year of Trump’s pick for the Supreme Court, Justice Brett Kavanaugh, conservatives now have a 5-4 edge on the nation’s highest court, raising fears among abortion rights supporters that the 1973 Roe v Wade ruling could be weakened or overturned.

Currently, laws governing late-term abortions vary state by state.

Trump criticized a New York law enacted last month that provides strong abortion rights protections, including late-term abortions when the mother’s health is endangered.

In his speech, he said lawmakers in the state “cheered with delight” at the law “that would allow a baby to be ripped from the mother’s womb moments before birth.”

The Republican president also seized on a controversy surrounding Virginia Governor Ralph Northam, repeating Republicans’ accusations that Northam, a Democrat, advocated infanticide when he defended a bill that would have lifted restrictions on later-term abortions.

Northam has said his comments were misinterpreted. “Extrapolating otherwise is bad faith,” his spokeswoman, Ofirah Yheskel, said last week.

The embattled Virginia governor is facing a separate controversy over a racist photo in his 1984 medical school yearbook, but has resisted calls to resign.
