Unions Dispute Detroit Bankruptcy

Objections to Detroit’s bankruptcy have been filed in federal court by trade unions, pensioners and even some private citizens.

The group is claiming the move by the city to seek bankruptcy protection is unconstitutional. Ironically, the creditors of the city have filed no objections to the city’s bankruptcy filing.

Detroit filed last month for bankruptcy protection claiming debts of over $18 billion.

The objecting parties claim the move violates the Michigan state constitution’s protections to worker benefits. They also say that Chapter 9 of the U.S. Bankruptcy code is in violation of the U.S. Constitution.

The city’s tax base has significantly declined over the last decade as many people fled the city in the wake of unemployment and economic hardship. The city has to prove to a federal judge it is in insolvent and has negotiated with creditors in good faith before they can be certified for a bankruptcy proceeding.
